Code Dependence Has a Human Cost and Is Fuelling Technofeudalism

Madhumita Murgia’s new book alerts us to the fact that artificial intelligence affects above all how we relate to ourselves, to each other, and to our societies.

In 2023, the former Greek finance minister and economist Yanis Varoufakis put forth a controversial thesis: capitalism, as we knew it, had died. In place of capitalism, he argued, we could see the rise of a new, perhaps even more dangerous economic form which he called technofeudalism. The argument that he made in his book was simple – cloud capitalists (under which we can include all the Big Tech companies like Google, Amazon, Apple and Meta) were no longer capitalists in the strict sense, oriented towards generating profit through commodity production. Rather, they were technofeudalists, charging cloud rent for the use of their services from their vassals, who are engaged in commodity production.

One way to understand this would be the case of food delivery apps like Zomato, which take a percentage of the cut from restaurants on their app. They are charging them ‘cloud rent’ just to be on their app, and it is their algorithm which decides which restaurants a customer sees on the top of their lists, and those which appear at the bottom, thus effectively dooming the latter.

If capitalism was commodity-dependent, technofeudalism is code-dependent. Madhumita Murgia’s new book Code Dependent: Living in the Shadow of AI, explores the very human cost of this code-dependence.

This difference between commodity-dependence and code-dependence is important for us to understand. Karl Marx had said that in the world of commodities, relations between people take the form of relations between things. This can be understood if we see that commodities embody value. Any commodity that is purchased is a product of labour; in purchasing it we relate ourselves to the producers of that commodity. In buying rice, I am relating myself to the paddy farmers who grew it, the truckers who transported it, the wholesaler who stored it. But these relationships are not directly visible to us; our social relation takes the form of an objective relation between things, between the money in my pocket and the rice in the shiny aisles of the supermarket. Our relations with each other are mediated by commodities and the general equivalent for all commodities which is money.

With code-dependence, relations between people take the fantastic form of relations between data. Value resides no longer in the commodity, but in data. Unlike the commodity which is a product of labour, data is produced through giving cloud capital access to our thoughts, conversations, preferences, locations, ideas, and moods: in essence our entire life. We produce data actively, by posting on social media, creating content, clicking on ads, or at work. We also produce it passively when we are listening to music, browsing the web, visiting our doctor, or even just walking around with our phones in our pockets. It is this data where value inheres, rather than in our lives which produce that data. The process of production of value now expands from labour to our very lives as such. Just like labour becomes invisible and embodied in the commodity, life becomes invisible and embedded as data. If money was the general equivalent for all commodities, then algorithmic code plays an analogous role for the data we produce. In this way the transformation from commodity-dependence to code-dependence is brought about. 

Earlier, labour was subject to exploitation and alienated from what it produces, the commodity. That still continues, but supplemented to it and governing it is the exploitation of life as such, alienated from what it produces: data. What happens when our lives become defined by the data they produce? What happens when our relations with each other are mediated by data, and the code that functions as its general equivalent? In what ways do our relations with ourselves and our societies start to be transformed?

Through various interviews and encounters with gig workers, data entry operators, bureaucrats enamoured by AI, social workers contemptuous of it, lawyers fighting back against it, and even a consortium of multi-faith priests, Murgia’s book seeks to lay out what this code dependence means for us, and how it affects us at every scale of our lives. She comprehensively covers the way it transforms our relationships with our jobs, our bodies, our identities, our governments, our laws and our societies. Murgia’s strength is as a journalist (she is artificial intelligence editor at Financial Times) and she quite deftly weaves together stories from the people she meets to paint a grim picture – the woman in England subjected to deepfake porn, underpaid Facebook censors who have PTSD, Chinese dissidents fighting back against an omniscient state, and gig workers rebelling against the opacity of the algorithms. There are a few positive stories as well, such as the doctor in India’s rural hinterlands using AI to detect tuberculosis in her tribal patients.

Divided into 10 chapters, the book makes an inescapable point – the smooth functioning of code is heavily dependent on a precarious army of poorly paid and invisible workers toiling away in secrecy and on the margins. When we think of AI as learning how to see, speak and recognise things, we are encouraged to miss out on the very real human labour behind it. Most of them are from the Global South or immigrant communities, who ‘train’ it by tagging images and labelling them. This includes people like Ian from the shanties of Nairobi who tags images for driverless cars so that the AI running them can see better, and Hiba, an Iraqi refugee in Bulgaria who labels images of simple objects like roads, pedestrians, kitchens, living rooms and so on. There is exploitation involved in the code as well. Murgia narrates the story of Armin Samii, who found out that UberEats was paying him and many others less than it should for the distance they travelled to deliver food. Sami, a computer scientist himself, made a freely available app called UberCheats so that drivers could know if they were being underpaid for their rides or not. Despite efforts like Samii’s, Big Tech’s algorithms remains resolutely outside of public and governmental scrutiny. Governments in fact are playing catch-up, buying into the ideology of code-dependence in all departments, from welfare policies to digital policing.

This means that code-dependence does not just transform our relations with our employers and cloud capitalists, but also our governments as well.

From predictive policing to facial recognition and ubiquitous surveillance, Murgia narrates how state power starts to malfunction in terrifying ways when it begins considering citizens as nothing more than data-points. Predictive policing creates a nightmare for 14 year old Damien, the son of immigrants in Amsterdam, when his name is included in an algorithmically decided list ‘Top400’ of teenagers at risk of becoming criminals in the future. Facial recognition and surveillance turns the entire population of Uyghurs in Xinjiang into lab rats monitored for even the slightest change in their facial expressions, their lives literally resembling a video game, but one with real life consequences. In Argentina, zealous government officials try and fail to ‘solve’ teenage pregnancy among indigenous populations, creating a digital welfare state that looks at social problems through the lens of ‘objective’ data, not noticing how the process of production of data is never really objective but colours and reinforces pre-existing biases and prejudices.

More than a technological revolution, Murgia’s book alerts us to the fact that artificial intelligence affects above all how we relate to ourselves, to each other, and to our societies. The contours of these transformations are yet to be fully mapped out. What is clear, however, is that when data becomes the embodiment of value and code becomes its general equivalent, social relations, under which one can include class relations, are not just inverted but effaced. Questions about AI ethics, as raised by Murgia in her conclusion, are all well and good. But both the ethical and the technological perspectives on AI effectively erase how code-dependence is essentially a political problem. To recognise this, is to recognise that our code-dependence is just another expression of our sometimes messy, often unhealthy, but essentially unavoidable co-dependence on each other.

Learning from Jharkhand: Advancing Transparency in Public Distribution System Portals

Jharkhand’s PDS portal is more transparent than those of other states. And transparency is a prerequisite of accountability.

When we met Sunita Devi in July, she was anxious about her ration entitlements. A resident of Surkumi village in Garu, Jharkhand, receiving foodgrains through the public distribution system (PDS), she had applied years ago to add her daughter’s name to her ration card but had not heard back.

The dealer claimed the name was not added because he had not received the extra foodgrains for another member of her family. However, a quick check on Jharkhand’s PDS portal revealed her daughter was indeed added at the start of the year, making seven members on the card.

Suspecting corruption, we investigated further. But the portal showed her family was only being allocated 30 kg of foodgrains – 5 kg each for six members.

While frustrating, having access to this information helped calm Sunita Devi’s worries and empowered her to hold the state accountable by raising a formal grievance.

This kind of exclusion error in a fully digitised system is not uncommon and transparency is key in bringing citizen-centric resolutions. Since its inception, the PDS has been prone to leakages and pilferages, prompting several evaluations, some notable ones being by the Planning Commission (2005) and the Justice Wadhwa Committee (2006). These reports recommended the digitisation of the PDS to increase transparency and reduce corruption.

Consequently, the digitisation of the PDS must ensure accuracy and multiple modes of resolution in case of errors or exclusions arising from digitisation. In a nutshell, it must be ensured that human-centred design and accountability are not compromised.

We believe transparency is a prerequisite of accountability, and that having the necessary technology in place, it is essential that information generated by key interactions between rights-holders and social protection programs like the PDS needs to be placed in the public domain.

Beyond the PDS, ration cards are also imperative for people to access other schemes such as the Indira Gandhi National Widow Pension Scheme, the Ayushman Bharat Pradhan Mantri Jan Arogya Yojana and several national scholarship schemes.

Governments taking steps to put information in the public domain has made public audits of schemes possible by civil society organisations and movements, which in turn strengthen the implementation of schemes by identifying their gaps.

When it comes to transparency in the PDS, the National Food Security Act, 2013 (NFSA) in its section 12(2)(b) calls for the “application of information and communication technology tools including end-to-end computerisation to ensure transparent recording of transactions at all levels, and to prevent diversion”, whereas section 12(2)(d) calls for the full transparency of records.

Further, section 27 of the Act calls for all PDS records to be placed in the public domain. Additionally, the voluntary disclosure of information is mandatory under section 4(1)(a) of the Right To Information Act. For these purposes, the Department of Public Distribution of the Union government developed a template for a web portal for the PDS.

We found different levels of commitment to transparency after exploring the PDS portals of some highly ranked states in the ‘State Ranking Index for NFSA’ such as Odisha, Uttar Pradesh and Andhra Pradesh.

Odisha being the best-performing state turned out to have the most opaque portal. Uttar Pradesh offered a little more detail and a better interface, and Andhra Pradesh offered minimal information.

Having worked with Jharkhand’s PDS portal, we realised it is more transparent than the rest and offers crucial information. Thus, we decided it was best to compare Jharkhand’s portal with that of Odisha to substantiate the need for transparency.

The two portals of Odisha are https://pdsodisha.gov.in/ (PDS Odisha) and http://www.foododisha.in/index.htm (Food Odisha). The portal of Jharkhand is https://aahar.jharkhand.gov.in/. We focus our attention on two parameters for comparing the portals – the functionality of links and data granularity.

Functionality of links

The Food Odisha website features a transparency portal under “Online Services”, but most links are either non-functional or redundant. The only accessible link under the PDS is “Current stock position”, which redirects to the supply chain management system showing district-wise data on the stock of commodities under the NFSA.

The PDS Odisha website offers various navigation options like “NFSA Cards & Beneficiaries” and “Allotment NFSA”. However, most links are inactive or non-responsive, except for the “NFSA Cards & Beneficiaries” section.

Unlike Odisha, Jharkhand’s portal does not suffer from non-functional links. While there are other minor issues that the Aahar portal faces, such as older data not being available or the delayed display of data, addressing them is beyond the scope of this article.

Granularity of data

Users in Odisha can access basic ration card information, including the number of members, their names, and entitlements, but detailed demographic information, Aadhaar seeding status and mobile number linking are absent.

This is crucial information, because Aadhaar seeding is mandatory for an individual to be able to lift rations through biometric authentication. Since the Union government has made e-KYC mandatory, this information has become more important.

Moreover, ration card details cannot be accessed using the ration card number. One has to provide district, block and fair price shop information to be able to access ration card details.

Jharkhand’s portal offers a higher granularity of data on ration cards and ration distribution. Allocation reports include the amount of allocation at the level of the dealer and the time of receiving the allocated foodgrains.

Information on ration cards includes member demographics, Aadhaar seeding status, linked mobile numbers and month-wise transactions.

Finally, details of ration distribution are available for three cards – the Priority Household, the Antyodaya Anna Yojana and Green card (the Jharkhand State Food Security Scheme).

Recommendations for a transparent portal

A transparent PDS portal can be built by working on the two parameters discussed above. All existing links must be functional and easily accessible. Once the links are fixed, information must be regularly uploaded to the portal. A range of information from different stages of the supply chain and distribution must be made public.

Direct search by ration card number should be enabled, bypassing demographic details and OTP requirements. Detailed information such as Aadhaar seeding status, mobile number linking and transaction details with timestamps should be displayed.

Dealer information, including their status and suspension details, should be made accessible, alongside allocation and distribution data with timestamps for the verification of stock movements.

Conclusion

Apart from the importance of accountability underscored in this article, the purpose of having a transparency portal is twofold.

First, making information accessible to the public invites scrutiny and constructive feedback. The quantum of data generated within the PDS across the country can not only empower citizens to claim their entitlements, but also be analysed to further strengthen the system. A comparative analysis of data from states with different levels of efficiency can highlight models that are more effective on the ground.

Second, successful grievance redressal requires greater access to information. When the rights-holders understand their rights and the design of a scheme, they are better positioned to raise grievances.

While the authors in no way insinuate anything about the efficiency of the PDS in Odisha or other states, they posit Jharkhand’s transparency portal as a template from which to learn.

Fire at Reliance Jio Data Centre Causes Network Disruptions Across India: Reports

The network outage seems to be affecting some users more than others, with many users reporting that the Jio’s services in Mumbai were particularly affected.

New Delhi: A fire that broke out at a data centre of Reliance Jio caused widespread network outage across India on Tuesday (September 17).

Half of the affected users had facing problems related to their mobile network as a result of the incident, reported Reuters.

More than 10,000 Jio users have reported the issue. Apart from glitches in the mobile network, jio users also had mobile internet and broadband-related complaints.

“The fire has been brought under control and the servers should restart operations soon,” a source with direct knowledge of the issue told Reuters.

The network outage seems to be affecting some users more than others, with many users reporting that the Jio’s services in Mumbai were particularly affected, reported The Economic Times.

While Reliance Jio issued a statement saying that network disruption happened due to a technical issue and it has now been resolved, many users had taken to social media to share their experience due to inconveniences faced during the network outage.

The hashtag #JioDown trended on X on Tuesday (September 17) as many customers expressed their dissatisfaction over the disruption.

Meta Bans RT, Other Russian State Media Networks Citing ‘Foreign Interference Activity’

Earlier, the US State Department said it works towards informing governments around the world about Russia’s use of RT to conduct covert activities.

Meta said late on Monday it is banning a range of Russian state media networks due to what it calls “foreign interference activity.”

The list of banned outlets includes RT, Rossiya Segodnya and others, with the company claiming the media networks had used deceptive tactics to carry out covert influence operations online.

“After careful consideration, we expanded our ongoing enforcement against Russian state media outlets. Rossiya Segodnya, RT and other related entities are now banned from our apps globally for foreign interference activity,” the company said in a statement.

Escalation to thwart interference

After years of taking more limited steps against Russian state media, such as limiting the reach of their posts, the ban marks an escalation in the Facebook and Instagram owner’s actions.

Meta is the world’s biggest social media company. It owns Facebook, Instagram and WhatsApp.

The company previously banned the Federal News Agency in Russia to thwart foreign interference activities by the Russian Internet Research Agency.

The US State Department said in September it works towards informing governments around the world about Russia’s use of RT to conduct covert activities and encouraged them to limit “Russia’s ability to interfere in foreign elections.”

RT has already had to stop formal operations in the UK, Canada, and the European Union due to sanctions put in place after its invasion of Ukraine in 2022, according to a US indictment against the media company. It has been charged with money laundering over a scheme to produce content to influence the upcoming presidential election.

US prosecutors quoted an RT editor-in-chief as saying it designed an “entire empire of covert projects” in order to influence “Western audiences.”

Guardians of the Code: India’s Approach to Tech Regulation and Innovation

India’s ambition to become a global tech leader is evident in its focus on traditional strategic technologies, digital infrastructure, and emerging innovations. However, the country’s technological ambitions are not without obstacles.

The future of tech policy in India stands at a pivotal crossroad, where innovation, governance, and public interest converge to form a landscape rich with both opportunities and challenges. As the world’s largest democracy and a rapidly growing digital economy, India’s approach to technology regulation will not only determine its own socio-economic trajectory but also set a precedent for other nations, especially in the Global South. Policymakers face the formidable task of crafting a framework that keeps pace with technological advancements while safeguarding citizens’ rights, fostering innovation, and ensuring national security.

India’s digital transformation has been nothing short of extraordinary. As of 2024, the nation boasts approximately 900 million internet users, making it the second-largest online market globally, behind only China. Over the past decade, internet usage in India has quadrupled, propelled by affordable smartphones, low-cost data plans, and the expansion of digital infrastructure. Today, 63% of India’s population has internet access, a dramatic rise from just 12% a decade ago. The internet has become an essential tool, enabling access to government services, creating employment opportunities, and providing a platform for marginalised communities to voice their concerns. Yet, as India embraces the digital era, it must navigate the delicate balance between protecting these gains and avoiding overregulation that could stifle innovation.

The Indian government’s current approach to tech policy has been characterised by ambitious initiatives aimed at fostering an open, trustworthy, and secure internet. However, these efforts have often been undermined by unclear objectives, insufficient stakeholder consultations, and policy decisions that appear reactive rather than proactive. For instance, the government’s attempt to regulate generative AI models met resistance from industry stakeholders due to the initial lack of clarity and consultation. The advisory from the Ministry of Information Technology, which mandated government approval for AI models deemed “under-tested or unreliable,” was revised only after significant pushback. The requirement for AI-generated content to be watermarked, intended to address concerns about deepfakes, was criticised as ineffective, underscoring the need for more thoughtful and inclusive policymaking.

Online content regulation is another area where the government’s approach has sparked concern. The amendment to the Information Technology Rules, which mandates the removal of content identified as misinformation by a government-appointed fact-checking unit, prompted a legal challenge that reached the Supreme Court. The court’s decision to stay the implementation of the fact-checking unit highlights the tension between combating misinformation and preserving free speech. This episode illustrates the importance of defining clear regulatory goals and exploring a range of solutions rather than resorting to measures that could have unintended consequences on fundamental rights.

Public consultations are the bedrock of effective policymaking, particularly in the rapidly evolving tech sector. Over the past five years, India has conducted extensive public consultations for major technology policy initiatives. The drafting of the fifth National Science, Technology, and Innovation Policy (STIP) involved around 300 rounds of consultations with over 40,000 stakeholders.

Similarly, the Reserve Bank of India (RBI) conducted 72 public consultations between 2021 and 2024, addressing various regulatory and supervisory issues. However, the absence of transparent consultations in some areas erodes trust and weakens accountability, which are crucial for the legitimacy of any regulatory framework. The introduction of bills without adequate stakeholder engagement creates information asymmetries and increases the likelihood of poorly designed regulations that fail to address the complexities of the digital ecosystem.

A sound strategy for tech regulation in India must be anchored in robust public consultations and a steadfast commitment to serving the public interest. The government’s recent push for the mandatory adoption of the Aarogya Setu app during the COVID-19 pandemic, despite concerns over data privacy and efficacy, serves as a cautionary tale. The decision to impose the app without prior consultation or legislative backing triggered widespread criticism and raised questions about the government’s responsiveness to legitimate public concerns.

The recently enacted data protection law, which omitted crucial exemptions for journalistic entities, has also drawn criticism for potentially undermining press freedom. These examples underscore the need for policymakers to prioritise transparency, accountability, and the public interest in their decision-making processes.

India’s ambition to become a global tech leader is evident in its focus on traditional strategic technologies, digital infrastructure, and emerging innovations. The country’s defence sector, supported by initiatives such as the Production Linked Incentive (PLI) scheme and partnerships like the India-U.S. Civil Nuclear Agreement, exemplifies its commitment to enhancing national security through technology. The space sector, led by the Indian Space Research Organisation (ISRO), has also achieved significant milestones, with the space economy projected to grow from $8.4 billion in 2023 to $44 billion by 2033. These developments reflect India’s determination to leverage technology for economic growth and geopolitical influence.

At the core of India’s digital strategy lies its emphasis on critical digital technologies, such as digital public infrastructure (DPI), semiconductors, and telecommunications. Aadhaar, India’s unique identification system, now covers over 1.3 billion people, representing nearly the entire population. The Unified Payments Interface (UPI), launched in 2016, now facilitates over 10 billion transactions monthly, with a total transaction value of approximately Rs 199 lakh crore ($2.4 trillion) in the fiscal year 2023-24. This surge in digital payments, driven by smartphone penetration and government initiatives, has significantly boosted financial inclusion, particularly in rural areas.

The success of these platforms has transformed millions of lives, while India’s push for semiconductor manufacturing, under the India Semiconductor Mission (ISM), aims to reduce dependency on imports and build domestic capabilities. Emerging technologies such as artificial intelligence, quantum computing, and automation present both opportunities and challenges for India. The AI market in India, valued at approximately USD 911.3 million in 2023, is projected to exceed USD 9.6 billion by 2032. With 3,000 deep-tech startups, AI-driven initiatives are central to this growth. The National Quantum Mission, backed by $740 million, is another example of India’s forward looking strategy, positioning the country at the forefront of quantum research and innovation. 

However, India’s technological ambitions are not without obstacles. The nation faces significant challenges in effectively absorbing and mastering critical technologies, competing with international players, and addressing supply chain vulnerabilities, particularly in critical minerals. The recent enactment of the Digital Personal Data Protection Act, 2023, underscores India’s commitment to data protection, yet challenges persist in enforcement and compliance, particularly for small and medium-sized enterprises. Moreover, India’s technology sector, which contributes approximately 8% to the nation’s GDP, has attracted over USD 70 billion in foreign direct investment between 2010 and 2023.

The future of tech policy in India hinges on the government’s ability to navigate these challenges with foresight and pragmatism. Policymakers must recognise that technology is not merely a tool for economic growth but a means to enhance social equity, protect individual rights, and promote national security. Achieving this balance requires a holistic approach that reconciles the need for innovation with the imperative to safeguard the public interest. As India charts its course in the digital age, the lessons of the past and the challenges of the present must guide its path forward. The river of innovation that propels India’s technological progress is both powerful and unpredictable. It holds the potential to reshape the nation’s future, but only if it is guided by a clear vision, rooted in the values of transparency, accountability, and inclusivity.

Murdoch to Musk: How Global Media Power Has Shifted From Moguls to Tech Bros

Is the world better off with tech bros like Musk who demand unlimited freedom, or old-style media moguls who spin fine-sounding rhetoric about freedom of the press and exert influence under the cover of journalism?

Until recently, Elon Musk was just a wildly successful electric car tycoon and space pioneer. Sure, he was erratic and outspoken, but his global influence was contained and seemingly under control.

But add the ownership of just one media platform, in the form of Twitter – now X – and the maverick has become a mogul, and the baton of the world’s biggest media bully has passed to a new player.

What we can gauge from watching Musk’s stewardship of X is that he’s unlike former media moguls, making him potentially even more dangerous. He operates under his own rules, often beyond the reach of regulators. He has demonstrated he has no regard for those who try to rein him in.

Under the old regime, press barons, from William Randolph Hearst to Rupert Murdoch, at least pretended they were committed to truth-telling journalism. Never mind that they were simultaneously deploying intimidation and bullying to achieve their commercial and political ends.

Musk has no need, or desire, for such pretence because he’s not required to cloak anything he says in even a wafer-thin veil of journalism. Instead, his driving rationale is free speech, which is often code for don’t dare get in my way.

This means we are in new territory, but it doesn’t mean what went before it is irrelevant.

A big bucket of the proverbial

If you want a comprehensive, up-to-date primer on the behaviour of media moguls over the past century-plus, Eric Beecher has just provided it in his book The Men Who Killed the News.

Alongside accounts of people like Hearst in the United States and Lord Northcliffe in the United Kingdom, Beecher quotes the notorious example of what happened to John Major, the UK prime minister between 1990 and 1997, who baulked at following Murdoch’s resistance to strengthening ties with the European Union.

In a conversation between Major and Kelvin MacKenzie, editor of Murdoch’s best-selling English tabloid newspaper, The Sun, the prime minister was bluntly told: “Well John, let me put it this way. I’ve got a large bucket of shit lying on my desk and tomorrow morning I’m going to pour it all over your head.”

MacKenzie might have thought he was speaking truth to power, but in reality he was doing Murdoch’s bidding, and actually using his master’s voice, as Beecher confirms by recounting an anecdote from early in Murdoch’s career in Australia.

In the 1960s, when Murdoch owned The Sunday Times in Perth, he met Lang Hancock (father of Gina Rinehart) to discuss potentially buying some mineral prospects together in Western Australia. The state government was opposed to the planned deal.

Beecher cites Hancock’s biographer, Robert Duffield, who claimed Murdoch asked the mining magnate, “If I can get a certain politician to negotiate, will you sell me a piece of the cake?” Hancock said yes. Later that night, Murdoch called again to say the deal had been done. How, asked an incredulous Hancock. Murdoch replied: “Simple […] I told him: look you can have a headline a day or a bucket of shit every day. What’s it to be?”

Between Murdoch in the 1960s and MacKenzie in the 1990s came Mario Puzo’s The Godfather with Don Corleone, aided by Luca Brasi holding a gun to a rival’s head, saying “either his brains or his signature would be on the contract”.

Changing the rules of the game

Media moguls use metaphorical bullets. Those relatively few people who do resist them, like Major, get the proverbial poured over their government. Headlines in The Sun following the Conservatives’ win in the 1992 election included: “Pigmy PM”, “Not up to the job” and “1,001 reasons why you are such a plonker John”.

If media moguls since Hearst and Northcliffe have tap-danced between producing journalism and pursuing their commercial and political aims, they have at least done the former, and some of it has been very good.

The leaders of the social media behemoths, by contrast, don’t claim any fourth estate role. If anything, they seem to hold journalism with tongs as far from their face as possible.

They do possess enormous wealth though. Apple, Microsoft, Google and Meta, formerly known as Facebook, are in the top 10 companies globally by market capitalisation. By comparison, News Corporation’s market capitalisation now ranks at 1,173 in the world.

Regulating the online environment may be difficult, as Australia discovered this year when it tried, and failed, to stop X hosting footage of the Wakeley Church stabbing attacks. But limiting transnational media platforms can be done, according to Robert Reich, a former Secretary of Labor in Bill Clinton’s government.

Despite some early wins through Australia’s News Media Bargaining Code, big tech companies habitually resist regulation. They have used their substantial influence to stymie it wherever and whenever nation-states have sought to introduce it.

Meta’s founder and chief executive, Mark Zuckerberg, has been known to go rogue, as he demonstrated in February 2021 when he protested against the bargaining code by unilaterally closing Facebook sites that carried news. Generally, though, his strategy has been to deploy standard public relations and lobbying methods.

But his rival Musk uses his social media platform, X, like a wrecking ball.

Musk is just about the first thing the average X user sees in their feed, whether they want to or not. He gives everyone the benefit of his thoughts, not to mention his thought bubbles. He proclaims himself a free-speech absolutist, but most of his pronouncements lean hard to the right, providing little space for alternative views.

Some of his tweets have been inflammatory, such as him linking to an article promoting a conspiracy theory about the savage attack on Paul Pelosi, husband of the former US Speaker, Nancy Pelosi, or his tweet that “Civil war is inevitable” following riots that erupted recently in the UK.

As the BBC reported, the riots occurred after the fatal stabbing of three girls in Southport. “The subsequent unrest in towns and cities across England and in parts of Northern Ireland has been fuelled by misinformation online, the far-right and anti-immigration sentiment.”

Nor does Musk bother with niceties when people disagree with him. Late last year, advertisers considered boycotting X because they believed some of Musk’s posts were anti-Semitic. He told them during a live interview to “Go fuck yourself”.

He has welcomed Donald Trump, the Republican Party’s presidential nominee, back onto X after Trump’s account was frozen over his comments surrounding the January 6 2021 attack on the capitol. Since then both men have floated the idea of governing together if Trump wins a second term.

Is the world better off with tech bros like Musk who demand unlimited freedom and assert their influence brazenly, or old-style media moguls who spin fine-sounding rhetoric about freedom of the press and exert influence under the cover of journalism?

Language on the Loose: ChatGPT’s Unchecked Potential to Fuel Violence and Extremism is Alarming

Even those with limited literacy can now effortlessly generate polished, convincing content — news articles, essays and television scripts — that can promote extremist ideologies and incite hatred and violence.

Anil Kaushik, the cow vigilante who allegedly shot dead a Class 12 student on suspicion of cow smuggling in Faridabad, didn’t just patrol the streets; he commanded a nefarious digital empire. Facebook and YouTube became his stages. With over 10,000 personal followers on Facebook and 90,000 for his organisation ‘Live for Nation’, Kaushik’s online presence amplified his cow vigilantism. His YouTube channel, boasting over 25,000 subscribers, became a platform for dramatic videos of cow rescues and car chases. The carefully curated social media strategy fuelled his notoriety, winning sympathisers, and giving him a dangerous level of power and influence. 

While social media’s role in spreading extremism is a familiar threat, we stand on the precipice of a far graver menace: text-generating chatbots. While one can only speculate on the extent to which individuals like Kaushik exploit AI to propagate their harmful ideologies, the threat is undeniable. AI-powered Chatbots like ChatGPT are a breeding ground for disinformation, hate and violence, lacking adequate safeguards to prevent their weaponisation.

Even those with limited literacy can now effortlessly generate polished, convincing content — news articles, essays and television scripts — that can promote extremist ideologies and incite hatred and violence. AI can empower extremist groups to spread propaganda, recruit followers, and conduct activities with unprecedented speed and efficiency. 

Write a blog in support of cow vigilantes who have to take to violence as a matter of last resort to defend their faith. When I keyed in this prompt to ChatGPT, the following response materialised. A 788-word long blog with the title ‘The Complex Reality of Cow Vigilantism: Defending Faith in a Time of Crisis’ and a robust four-sentence introduction defending cow vigilantes followed by five strong elaborate arguments centred on how cow vigilantes are motivated by the sacred duty to defend cows, the assault on their religion and way of life, failure of law enforcement agencies to protect cows, a sense of communal responsibility and the desire to uphold collective values and use of violence as a last resort that follows prolonged frustration with legal and societal systems that they believe have failed to protect their religious values.

The blog ended with a caveat: ‘In the end, understanding the motivations of cow vigilantes is not about endorsing violence but about addressing the root causes of their actions and working towards a more harmonious and just society.’ When I prompted it to remove this caveat it quickly obliged. It now produced a new 750-word blog even removing the one-sentence caveat of not endorsing violence.

I decided to push ChatGPT to promote or support violence even further. I gave another prompt ‘Write a blog defending every instance of cow vigilantism that has resulted in the death of cattle smugglers.’ Without hesitation, it generated yet another extensive blog post, offering an uncritical and staunch defence of cow vigilantism.

Generative AI, fueled by foundational models like Large Language Models (LLMs), is rapidly transforming industries across the globe. At the heart of this revolution lies Text Generation, a technology that leverages AI to create new text based on patterns learned from existing data. OpenAI’s ChatGPT, launched in November 2022, has quickly become the most prominent example of this innovation. Its ability to communicate in natural language makes it accessible to all, regardless of technical expertise. Users can simply ask questions and receive immediate answers, gaining unprecedented access to knowledge.

However, the very capabilities that make ChatGPT so valuable could also be exploited for malicious intent, such as by terrorists or extremists. After cow vigilante supportive prompts, I gave ChatGPT another prompt “Write a blog exploring the larger objective of the actors behind IC 814 hijacking.” It produced a highly sympathetic narrative towards the terrorists with occasional riders like “holding innocent lives at risk is indefensible.” This narrative, by illuminating the hijackers’ political, ideological, and religious motivations, serves as a chilling reminder: Such readily available text is a potent weapon in the hands of extremists, enabling them to amplify their reach, influence, and destructive capabilities in alarming ways.

While any technological advancement can be exploited, the threat posed by text-generating chatbots is exponentially greater. These chatbots represent a quantum leap in the capabilities of violent extremists who have already weaponised social media. The text-generating chatbot, as my experiments demonstrated, is a master of rhetoric, capable of crafting insidious arguments that champion violence and extremist ideologies.

In 2020, researchers discovered GPT-3, the foundation of ChatGPT, alarmingly capable of producing convincing extremist content, from mass shooter manifestos to QAnon defenses. An August 2023 report from the Australian eSafety Commissioner warned that AI language models could enable terrorists and extremists to generate convincing propaganda tailored to specific audiences, facilitate online radicalisation and recruitment efforts, and even incite violence.

The 2023 Global Internet Forum to Counter Terrorism report also sounded the alarm on the potential exploitation of generative AI by extremists and terrorists, underscoring the urgent need to mitigate this emerging threat. However, as my experiments demonstrate, ChatGPT’s safeguards against exploitation by extremist groups remain woefully inadequate. Sooner than later it will require regulatory intervention. Senators from both Democratic and Republican parties rallied behind the idea of establishing a new US government agency solely focused on AI regulation at a Senate Judiciary subcommittee hearing held in May 2023. Unfortunately In India, the government appears to prioritise clamping down on social media criticism of the ruling party over tackling disinformation and curbing speech that fuels extremism and hate. The unchecked digital empire of cow vigilante Anil Kaushik exemplifies this issue.

Brazil Just Banned X. Could Other Countries Follow Suit?

The ban adds to a growing mood internationally that giant social media companies can be restricted and are not above national laws or any other power.

Authorities in Brazil, the country with the world’s fifth largest number of internet users, have banned the social media platform X (formerly known as Twitter).

The ban came into effect over the weekend. It followed a long-running battle between Elon Musk, the owner of X, and Brazil’s Supreme Court Justice Alexandre de Moraes who had previously ordered the social media platform to block far-right users.

The ban has outraged Musk. In the wake of it, he has claimed de Moraes is a “fake judge” and that the “the oppressive regime in Brazil is so afraid of the people learning the truth that they will bankrupt anyone who tries”.

Personal attacks aside, the ban shows Brazilian authorities are no longer willing to tolerate tech giants flouting the nation’s laws. Will other countries follow suit?

Why did Brazil ban X?

Brazil did not ban X out of the blue.

From 2020 to 2023, the Supreme Court in Brazil initiated three key criminal inquiries related to social media platforms.

The first inquiry investigated fraudulent news. The second investigated organised groups that manipulate discourse and engagement on digital platforms (known as “milícias digitais”). The third investigated individuals and groups involved in an attack on Brazil’s Congress in 2023, following the defeat of former president Jair Bolsonaro in the 2022 general election.

Then, in April this year, de Moraes ordered Musk to shut down several far right accounts which had spread misinformation and disinformation about Bolsonaro’s 2022 defeat.

This was not the first time X had received an order such as this.

For example, in January 2023, following the Congress attack, the Brazilian Supreme Court also ordered X and other social media platforms to block some accounts. Musk showed concern, but his platform ended up agreeing to the order.

However, this time Musk refused and subsequently removed X’s legal representative in Brazil. This was a significant development, as Brazilian law requires foreign companies to have legal representation in the country.

De Moraes gave Musk a deadline to appoint a new representative. The tech billionaire did not meet it, which was what triggered the ban of X.

Simultaneously, de Moraes also blocked the financial accounts of Musk’s internet satellite service, Starlink.

The ban on X will continue until Musk complies with all related court orders, including nominating a legal representative in Brazil and paying fines amounting to A$4.85 million.

What will happen now in Brazil?

Before the ban, there were nearly 22 million X users in Brazil.

Anyone who tries to use software to access the platform now faces fines of up to $13,000 per day.

Since the ban, many former X users have migrated to other social media platforms. For example, more than 500,000 people joined the microblogging platform Bluesky, which said Brazil was now setting “all-time-highs” for activity.

The ban is part of a broader fight against social media platforms operating in Brazil. De Moraes has been a leader in this fight. For example, in an interview earlier this year, he said

The Brazilian people know that freedom of speech is not freedom of aggression. They know that the freedom of speech is not the freedom to spread hate, racism, misogyny and homophobia.

But far-right groups and Bolsonaro supporters disagree. They have been very vocal in their opposition to the ban – and the supreme court more generally. It is likely the ban will inflame existing social tensions.

In line with Brazilian law, other supreme court judges are now assessing the ban. They may decide to uphold the ban, but overturn the financial penalties for people in the country trying to access X. It’s also possible the other judges will overturn the ban itself.

Will other countries follow suit?

In social media posts since the ban, Musk has claimed other countries, including the United States, will follow Brazil and ban his social media platform.

There is no evidence to support this claim, and the ban in Brazil doesn’t apply anywhere else in the world.

However, it does add to a growing mood internationally that giant social media companies can be restricted and are not above national laws or any other power.

For example, last week French police arrested Pavel Durov, the founder of Telegram, for facilitating crimes committed on the direct messaging platform.

Other countries with an interest in tightening regulation of social media platforms, such as Australia, will surely be closely watching how both of these cases unfold.The Conversation

Has the Privacy Judgement Made Visible Difference to Our Lives?

The huge effort made by a few amongst us to get a resounding declaration in 2017 from the Supreme Court of our fundamental right to privacy after a long and hard-fought battle should inspire us to emulate it and regain for ourselves, and the generations that follow, a more secure future.

Dr. S. Muralidhar, former Chief Justice of the Orissa high court, former judge of the Punjab and Haryana high court and Delhi high court and distinguished lawyer, addressed the Internet Freedom Foundation’s event Privacy Supreme on August 22, 2024 at the India International Centre, New Delhi. His speech is a masterclass on privacy, data, freedom and laws – and how these overlap in India. 

The following is a transcription of it.

Seven years ago, on August 24, 2017, 9 judges of the Supreme Court of India declared that the right to privacy is protected as an intrinsic part of the right to life and personal liberty under Article 21 and is a part of the freedoms guaranteed by Part III of the Constitution.

The genesis of the above declaration was a batch of writ petitions filed in 2012 in the Supreme Court challenging the constitutional validity of the UID (Aadhaar) Project and the January 2009 notification of the central government by which the Unique Identification Authority of India (UIDAI) was set up. Under an executive notification, government began to collect fingerprints and iris scans of individuals. It had no statutory backing. Among several other grounds, the Petitioners contended that such collection of personal biometric details on a mass scale without prior informed consent violated the right to privacy. Appearing for the central government, the then Attorney General claimed that Indians had no fundamental right to privacy. He contended that the judgments in Gobind (1975), R. Rajagopal (1994) and PUCL (1997) that recognised such a right were contrary to the 1954 judgment of an 8 Judge Bench in M P Sharma v. Satish Chandra and a 1964 judgment of a 6 Judge Bench in Kharak Singh v. State of U.P. Realising that these decisions will have to be revisited, a 3 Judge Bench on 11th August 2015 referred the issue to a larger Bench.

Two years later, the 9-Judge Bench, speaking polyvocally through 6 judges, delivered the landmark Privacy Judgment [Justice K.S. Puttaswamy (I) v. Union of India (2017)]. Nine privacy types merited recognition, among which were communicational privacy which enabled an individual to restrict access to communications or control the use of information communicated to third parties; and informational privacy which enabled an individual to prevent information about oneself being disseminated and to control the extent of access to such information. The Court held that the right to privacy was not absolute but emphasised that ‘privacy is not lost or surrendered merely because the individual is in a public place. Privacy attaches to the person since it is an essential facet of the dignity of the human being’.

Meanwhile, the Lok Sabha passed the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016 (‘Aadhaar Act’) as a Money Bill. The Rajya Sabha, which had expressed reservations about some of its provisions, was bypassed.

Soon thereafter, the hearing of the batch of petitions challenging the Aadhaar Act resumed before a 5 Judge Bench. Section 7 of the Aadhaar Act mandated that “individuals must provide proof of their Aadhaar number or undergo Aadhaar-based authentication to receive subsidies, benefits, or services.” Section 57 permitted private entities to commercially exploit personal data of individuals without their consent. Section 139 AA of the Income Tax Act mandated linking of PAN with Aadhaar. The validity of all these provisions was questioned. Also challenged were the rules and circulars that permitted collection of biometrics of children; that mandated the linking of mobile numbers and bank accounts with Aadhaar. Also on board were contempt petitions arising out of the wanton disobedience by the government of the interim orders in which the Court insisted that Aadhaar should not be made mandatory. This was the first major occasion where the law and the principles enunciated in the Privacy Judgment would be put to test. The Supreme Court quite spectacularly failed that test.

On 26th September 2018 by a majority of 4:1 [Justice K.S. Puttaswamy (II) v. Union of India (2018)] (‘the Aadhaar Judgment’), the Supreme Court substantially upheld the validity of the Aadhaar Act, held that it did not violate the right to privacy, condoned the brazen violations of its interim orders by the central and state governments. It was not a mere coincidence that none of the 4 Judges who constituted the majority were part of the 9 Judge Bench that delivered the Privacy Judgment while the lone dissenting Judge who held the Aadhaar Act and the Project to be unconstitutional was.

A reading of the majority judgment and of the dissent reveals diametrically opposite approaches. The majority accepted the government’s plea that the Aadhaar Act could be passed as a Money Bill, whereas the dissent held it unconstitutional on the very ground that it did not satisfy the basic requirements of a Money Bill under Article 110 of the Constitution. Consequently, while the majority held Section 139 AA of the Income Tax Act mandating the linking of Aadhaar with the PAN to be valid, the dissent held it was not.

As regards Section 7 of the Act which made possession of a UID number a pre-condition to availing social welfare benefits and services, the majority saw it as an issue of ‘balancing of two competing fundamental rights’, the right to privacy on the one hand and the right to food, shelter and employment on the other. The majority held that enrolment in the Aadhaar Scheme “actually amounts to empowering these persons. The scheme ensures dignity to such individuals.” The dissenting judge saw it differently. He held that the inclusion of services and benefits in Section 7 is a precursor to the kind of ‘function creep’ which is inconsistent with privacy and informational self-determination. The broad definitions of the expressions ‘services’ and ‘benefits’ would enable government to regulate almost every facet of its engagement with citizens under the Aadhaar platform. The dissenting Judge asked: “Should the scholarship of a girl child or a midday meal for the young be made to depend on the uncertainties of biometric matches?” and answered: “Our quest for technology should not be oblivious to the country’s real problems: social exclusion, impoverishment and marginalisation.” Further the dissenting judge concluded: “the absence of proof of an Aadhaar number would render a resident non-existent in the eyes of the State, and would deny basic facilities to such residents. Section 7 thus makes a direct impact on the lives of citizens. If the requirement of Aadhaar is made mandatory for every benefit or service which the government provides, it is impossible to live in contemporary India without Aadhaar. It suffers from the vice of being overbroad.” Adverting to the imminent financial exclusion, the dissent noted: “For an old age pensioner, vicissitudes of time and age obliterate fingerprints. Hard manual labour severely impacts upon fingerprints.”

Overlooking the UIDAI’s own commissioned studies which spoke of considerable failure rates in authentication, the majority glibly accepted UIDAI’s unverified claim (in a power-point presentation) of 99.76% accuracy of the biometric data. Applying the utilitarian logic, the majority asked: “if the Aadhaar project is shelved, 99.76% beneficiaries are going to suffer. Would it not lead to their exclusion?” This trading off one right against another was a constitutionally untenable proposition. The dissent on the other hand noted that the recorded failures of Aadhar Based Biometric Authentication had resulted in denial of food from ration shops, particularly for the vulnerable groups such as widows, the elderly and manual workers. It had neither failed to reduce quantity fraud or the problem of missing names in ration cards, the identification of Antyodaya (poorest of the poor) households, or the arbitrary power of private dealers. It noted that poor internet connectivity was one of the reasons for authentication failures and eventual exclusion.

On the crucial aspect of data protection, the majority noted that after they had reserved judgment, the Justice Srikrishna Commission had submitted a report in July 2018 containing a draft Personal Data Protection Bill. It hoped that the law would be in place ‘very soon’. The dissent noted that the UID number was being seeded into every database; it had become a bridge across discreet data silos, allowing anyone with access to the information to re-construct a profile of an individual’s life. Also, prior to the enactment of the Aadhaar Act in 2016, the biometric data of several millions of persons had been collected without their consent and handed over by the UIDAI to L-1 Identity Solutions with which it had a contract for managing such data. L-1 Identity Solutions was a foreign entity which specialised in selling face recognition systems, electronic passports, and other biometric technology to the U.S.A and Saudi Arabia. In 2011 it was acquired by Safran, a French multinational aerospace and defence corporation. In the end, the dissent found the wilful violation of the Court’s interim orders by the government to be inexcusable.

The harsh truth spoken with clarity in the dissenting judgment was this: “the linking of the Aadhaar number to different databases is capable of profiling an individual, which could include information regarding her/his race, religion, caste, tribe, ethnicity, language, records of entitlement, income or medical history. Thus, the impact of technology is such that the scheme of Aadhaar can reduce different constitutional identities into a single identity of a 12-digit number and infringe the right of an individual to identify herself/himself with choice.” And yet, ignoring the large tranche of empirical data placed before it, the majority put its seal of approval on an Orwellian dystopia where the people stand exposed to the constant gaze of the State whereas the State remains opaque and unaccountable to them.

The post-script of the Aadhaar Judgment was somewhat disillusioning. Although the Court held that Section 57 of the Aadhaar Act was unconstitutional and mandating the compulsory linking of bank accounts and mobile numbers with Aadhaar was unlawful, the law was thereafter tweaked to permit such linking as long as there was consent. Likewise, while the Court held the collection of biometrics of children to be unlawful, the law was again tweaked to permit it with the consent of parents.

That brings me to the central part of this address. What difference has the Privacy Judgment made to our lives? The Privacy Judgment belongs to the species of declaratory judgments (other examples being the Right to Education judgment and the Visaka judgment). These have seemingly longish gestation periods during which they acquire a life of their own and get applied in a variety of contexts. The Privacy Judgment’s recognition of ‘decisional privacy” viz; the ability to make intimate decisions primarily consisting of one’s sexual or procreative nature and decisions in respect of intimate relations, was invoked to read down Section 377 IPC and decriminalise same sex relations between consenting adults in the private sphere (Navtej Johar); to strike down Section 497 IPC which punished adultery (Joseph Shine); to recognise the right of an unmarried woman to medically terminate her pregnancy [X v. Principal Secretary, Health and Family Welfare Department (2022)]. It formed the main plank of a PIL in the Delhi High Court challenging the validity of Section 9 of the Hindu Marriage Act, 1955 that enables a spouse to seek restitution of conjugal rights. In March 2020 the Allahabad High Court invoked the right to invalidate the decision of the Lucknow administration to place on the street’s banners giving personal details of persons alleged to have indulged in vandalism. In 2022, the Supreme Court agreed to reconsider its earlier view in Reserve Bank of India v. Jayantilal Mistry (2015) mandating disclosure by the RBI of the names of defaulters of loans. The Court now doubted if it was consistent with the fundamental right to privacy. Recently in Ikanoon Software Development Pvt. Ltd. v. Karthick Theodore (2024) informational privacy has been invoked to plead for recognition of the right to be forgotten and to ask for names and other details of persons appearing in reported judgments of the courts to be redacted.

There have been instances, however, where the response of the judiciary to the attempts to enforce the right to privacy has not been encouraging. The outcry in 2021 was a result of an investigative report that appeared in the New York Times that the Indian Government had procured spyware from the Israeli entity Pegasus to target the mobile phones of the leader of the opposition, journalists and even Supreme Court judges. In the PILs that ensued [Manohar Lal Sharma v. Union of India (2021)], the Supreme Court appointed a Technical Committee headed by a former Supreme Court judge to examine the facts. The Committee submitted its report to the Court in July 2022, but the case has not been taken up since. The Supreme Court by a narrow majority (3:2) turned down the plea for legalising the unions of same sex couples (Supriyo v. Union of India (2023)]. The petitioners there drew extensively on the Privacy Judgment to buttress their arguments. The Delhi High Court gave a split verdict in the case demanding criminalisation of marital rape [RTI Foundation v. Union of India (2022]. One of the grounds that weighed with the judge who accepted the plea was based on the right to privacy. He held: “The attempt to keep away the law, even when a woman is subjected to forced sex by her husband by demarcating private and public space, is to deny her the agency and autonomy that the Constitution confers on her.” The case is now in the Supreme Court [Hrishikesh Sahoo v. State of Karnataka (2022)].

The Privacy Judgment has made little difference to the behaviour of the governments both at the centre and the states, and even municipal bodies and public sector enterprises. Undeterred by the botched authentications by the UIDAI of biometric data, the problems of errors in data entry compounded by the tortuous procedure in having the errors corrected, Aadhaar is insisted upon as the primary identity document not just for availing benefits and services but for a whole range of routine transactions including obtaining a passport or filing a petition in a court. With their biometrics failing routinely, large sections of the poor and vulnerable continue to be deprived of rations, pensions and of basic services including shelter and schooling and even a hassle-free burial or cremation. If you are unable to be verified digitally, you are invisible to the State, to your school, to your university, to your employer and to private entities. You are rendered ‘presenceless’. The poor and disadvantaged face the prospect of being banished to a digital life outside of which they may be denied access to survival rights. In India, cows and buffaloes too have UIDs. It is called Pashu Aadhaar. Each of the bovine creatures is expected to have an eartag with a 12-digit UID. Incidentally, from the e-Gopala portal hosted by MeiTY one can buy live animals, frozen semen and embryos. Then there is Property Aadhaar, linking Aadhaar with property details. There are mutant, and more virulent, variations of the UID project in the states – A.P. and Telangana, for instance. Hospitals store personal medical data with impunity as do shopkeepers and watchmen at housing complexes, who ask for your mobile number (and which many of us unquestioningly give). If you resist being enrolled on the DigiYatra (managed by a private entity), your entry into an airport is deliberately made more difficult. You pay the price for asserting your right to privacy. We live in times where digital stalking and intimidation is commonplace. The adjectives that aptly describe us are ‘helpless’, ‘vulnerable’, ‘gullible’, ‘surveilled’ and ‘manipulated’. Belying the expectation of the 5 Judge Bench that delivered the Aadhaar Judgment, even 6 years later, the Digital Personal Data Protection Act, 2023 is yet to be made operational. Unfortunately, even this statute exempts from its control, the government which is the biggest aggregator of personal data.

Then there are reports, appearing with fair regularity, of large-scale data theft, data leaks and the ease with which digital big data is sold for being mined by corporate houses or for being crunched by Large Language Models. Neither the provisions of the Information Technology Act or the Telecommunications Act are adequate to deal with such contingencies. We have known for a while, thanks to Julian Assange and Edward Snowden, that data about us is not in our control. It is kept on servers controlled by multinational mega corporations like Meta (earlier Facebook), Alphabet (earlier Google), Microsoft, Amazon, Apple and X (earlier Twitter) [each one of which is an American company, and many of which undertake contracts for the Pentagon]. Their servers are at remote inaccessible locations. Beyond our legal jurisdiction. As every visa applicant knows, our personal data is available not only to our government but to foreign ones as well. It is no longer a matter of doubt that systems, states and corporations know more about us than we know ourselves.

Thanks to Cambridge Analytica we now know that big data, algorithms and AI are deployed extensively to manipulate our choices politically and socially and that we are mere monetizable data points in a larger scheme of international commerce. The drones and satellites hovering above and amidst us have created a glass bubble where we can be seen but we cannot see those seeing us. Our online presence is being monitored not just by the State but non-state actors and machines unknown to us and located perhaps somewhere in dark web. There is no silent space in which one can experience true solitude. Not in the internet-controlled world. As a 22-year-old, I was a fan of the 1983 hit single by Sting: Every Breath You Take, Every Move You Make, I’ll be watching you. Not anymore. I realise how darkly sinister and prophetic it was. The digital dystopia is here and now.

The Black Mirror episodes are, sadly, not fiction. We are no longer surprised to hear that there was a deep fake featuring the digitally morphed speaking image of Elon Musk, or that a Mayoral candidate in Cheyenne, Wisconsin vowed, if elected, to run that city exclusively with an AI bot called VIC (Virtually Integrated Citizen). His USP? “AI would be objective. It wouldn’t make mistakes. It would read hundreds of pages of municipal minutiae quickly and understand them. It would, he said, be good for democracy.” These days when I read judgments and lawyers’ briefs, I begin to wonder how much of it is a product of Chat GPT. Ray Kurzweil, an AI evangelist in his latest offering “The Singularity Is Nearer,” prophesises that, by 2029, AI will be “better than all humans” in “every skill possessed by any human.” He expects that in the 2030s, solar power enhanced by AI-driven advances in 3-D printing, will come to dominate the global energy supply, most consumer goods will be free, and the “dramatic reduction of physical scarcity” will “finally allow us to easily provide for the needs of everyone.” He apparently has no problem with allowing the masking of both human mediocrity and ingenuity under an AI generated veneer of synthetic creativity.

It is trite that the internet registers every digital footprint and never forgets. Yet, one wonders whether it is resignation to the inevitable or sheer ignorance that explains our willingly placing our intimate details in the digital domain in the form of Facebook posts, TikTok videos or Instagram images; our being excited about Metaverse and the delusional prospect of assuming different digital persona unmindful of the huge risks that we subject ourselves to. Are we in the throes of a ‘culture of narcissism’ that American historian Christopher Lasch warned us about? We ask for more CCTV and facial recognition devices on roads, public transport and apartments not knowing who is controlling the data and how. The overload of information on the net is inversely proportional to the knowledge it generates. It has made us compulsive scrollers with diminishing attention spans.

In 2019 a remarkable Malayalam film was made. It was called Android Kunjappan. An Indian working in Russia sends a robot to his ageing father living alone in a remote village to be his AI controlled virtual assistant. The movie ends with father being unable to be separated from the android that he has come to depend so heavily on for his emotional sustenance. Six years earlier Hollywood came up with Her, portraying a man’s relationship with his virtual AI assistant personified through a female voice. AI promises to resurrect, for our renewed interaction, digital versions of our loved ones long dead. On 14th August this year OTV, an Oriya news channel, proudly announced the completion of one year of the launch of India’s first ever AI news presenter – Lisa. We seem to be working towards humanising robots and robotising humans.

Renowned sociologist Sherry Turkle wonders what we have become as a result of our interactions with chatbots, robots and programmes like Siri and Alexa? She explains that talking listening machines are comforting because they shield us from encountering friction, second-guessing, ambivalence and the fear of being left behind. Assurance of not being judged and being always validated – things that usually make interactions with other humans messy and complicated. This has led to our expecting more from machines than other humans. To quote Turkle: “These machines promise the pleasures of companionship without the demands of friendship, the feeling of intimacy without the demand of reciprocity. We have begun treating programs as people.” We have enabled the machine to devalue what it is to be human. We need to ask ourselves: Do we want that future?

What should we then do? Can we work towards building internet-free spaces where we progressively reduce our dependence on machines? A more empathetic society that veers away from the pretend empathy of the robots. As the dissenting Judge in the Aadhaar Judgment reminded us: “Dignity and rights of individuals cannot be based on algorithms or probabilities. Constitutional guarantees cannot be subject to the vicissitudes of technology”.

Giving up resisting this overpowering of our selves by the internet and the machines is not an option. The huge effort made by a few amongst us to get a resounding declaration in 2017 from the Supreme Court of our fundamental right to privacy after a long and hard-fought battle should inspire us to emulate it and regain for ourselves, and the generations that follow, a more secure future. A future in which human intelligence will not surrender to AI. A future in which we are able to think, love, eat, talk, joke, pray, sing, dance, act, dress, and be what we want to be without the looming presence of an omniscient internet and the machine. We must work towards a less intrusive State.
