POCSO Case: CID Questions Former Karnataka Chief Minister B.S. Yediyurappa

The case pertains to the accusations made by the mother of a 17-year-old girl who had alleged that the former chief minister had sexually assaulted her daughter when they had visited him at his Bengaluru residence this February seeking some help.

Bengaluru: The Criminal Investigation Department on Monday (June 17) has questioned former Karnataka chief minister B.S. Yediyurappa in connection with a Protection of Children from Sexual Offences Act, 2012 (POCSO Act) case.

As per a Deccan Herald report, Yediyurappa appeared at the CID headquarter in Bengaluru at 11 am and was questioned by a deputy superintendent of police-ranked official. He left around 2.40 pm.

The case pertains to the accusations made by the mother of a 17-year-old girl who had alleged that the former chief minister had sexually assaulted her daughter when they had visited him at his Bengaluru residence this February seeking some help. A complaint was also lodged against Yediyurappa under the Pocso Act and Section 354 A (Sexual harassment) of the Indian Penal Code (IPC) at the Sadashivanagar police station on March 14.

Notably, on June 14 while hearing the petition filed by Yediyurappa for quashing of the POCSO case and a petition seeking interim bail, the Karnataka high court ordered the investigating agency to not take any coercive measures against the former chief minister and directed him to appear before the investigators on June 17.

“The arrest is kept on hold until the next date of hearing,” single judge bench of Justice S. Krishna Dixit said, The Indian Express reported. He further asked the advocate general, “He is no Tom, Dick or Harry. He is not a bandicoot. He is the former chief minister of the state. Is it your case that he will flee away from the country by going to Delhi? So many things are taking shape in the political arena. He will come back. What is that he will be able to do going to Delhi?”

A day prior to this development, an Additional City Civil and Sessions and Fast Track Special Court (FTSC-1) on June 13 had issued a non-bailable warrant against Yediyurappa.

The Hindu had earlier reported that a writ petition was filed by the victim’s brother in the Karnataka high court asking why Yediyurappa was not arrested in connection with the case yet following which the CID had issued summons to the Bharatiya Janata Party (BJP) senior leader to appear for questioning on June 12. The department moved the court seeking Yediyurappa arrest since he responded saying he was in New Delhi and would appear for questioning on June 17.

The complainant who was the mother of the victim has passed away due to lungs cancer last month.

DH reported that the CID has recovered Rs 35,000 cash allegedly given to the victim and her mother, mobile phone belonging to the victim and her mother, retrieved data from the mobile phones and voice samples of Yediyurappa.

Arrest Warrant Against Former Karnataka CM B.S. Yediyurappa in POCSO Case

The Crime Investigation Department (CID) may arrest Yediyurappa following this development. 

Bengaluru: A Bengaluru court on Thursday (June 13) has issued a non-bailable arrest warrant against former Karnataka chief minister B.S. Yediyurappa in a Protection of Children from Sexual Offences Act, 2012 (POCSO Act) case.

As per a Bar and Bench report, the warrant was issued by Additional City Civil and Sessions Judge, (Fast Track Special Court-I) N.M. Ramesh. The Crime Investigation Department (CID) may arrest Yediyurappa following this development.

Yediyurappa has also moved an anticipatory bail petition before the high court fearing arrest.

The victim’s mother who was the complainant in this case had passed away in a city hospital last month due to lungs cancer.

Seven Years on, Jalpaiguri Child Trafficking Victims Await Justice

While the CID claims it is still investigating matters, affected families hold on to hope and several of the accused – said to have political connections – are out on bail.

Jalpaiguri: It has been over eight years since Kajal Basfor last saw her son, Ganesh. In 2016, Ganesh ran away after facing his mother’s scolding and a beating. As per the Child Helpline record, he was found at New Jalpaiguri Station in North Bengal, following which the police took him to a temporary shelter.

Kajal came to Jalpaiguri hoping for a reunion, but was instead locked up at a shelter home called Ashraya. Her three-year-old daughter Dipali was forcefully taken away to another shelter home, Bimala Shishu Griha. While Kajal was released after a few days, Dipali was held captive at the home.

Seeking help, Kajal and her husband approached the Jalpaiguri Child Welfare Centre and the district collector. The Child Welfare Centre clarified that two members of the Child Welfare Committee, seeing Kajal’s emotional state, deemed her unfit to raise a child, leading to their separation.

Kajal finally got to reunite with her daughter after a few months, but the search for Ganesh is still on. “They returned my daughter as she looks a lot like me. I heard that my son is living at a home, but I am yet to meet him,” said Kajal, who lives in Birpara, around 63 km from Jalpaiguri town in West Bengal.

In nearby Siliguri, Sanu Das is waiting to reunite with her daughter. Her two daughters, aged five and eight, went missing in 2016 while she was admitted to a hospital. Despite extensive searching, Sanu Das couldn’t find her daughters and sought help from the Darjeeling Legal Aid Forum.

The Jalpaiguri Child Welfare Committee (CWC) initiated an investigation into the short-stay homes where children were being taken. While one of the children was found at a shelter home, police investigations revealed that the younger child was sold to a childless couple. The CID summoned the couple to the Jalpaiguri CWC, where Sanu identified her daughter and demanded her return. However, the adoptive family is reluctant to relinquish rights over the child. In booth these cases, the shelter homes were being run by a teacher-turned-NGO owner, Chandana Chakraborty.

The case, and where it is now

In 2017, Jalpaiguri town was rocked by a large-scale child trafficking racket run by an orphanage owner with political connections. Seven years later, the CID is yet to file the final chargesheet even as three of the seven accused arrested by the police are out on bail. As per records, during this time, the CID has questioned 33 of the 73 witnesses, raising questions about the progress of the case.

“I have taken charge recently. Seven people were arrested during the initial days of the case – two were child welfare officials. The government officials are still in jail. Some politicians were also questioned. But my predecessor would know more,” Chayan Bhattacherjee, district inspector of Jalpaiguri, told The Wire.

The investigation began after authorities found babies being smuggled in biscuit boxes in Baduria, North 24 Parganas in 2016. This discovery led the Central Adoption Resource Authority (CARA) to file a complaint with the CID in January 2017. The complaint pointed to “irregularities” at three homes run by Chandana Chakraborty in Jalpaiguri.

Around the same time, in 2016, a member of the Government Child Welfare Committee in Jalpaiguri, Subodh Bhattacharya, raised another red flag. He accused an NGO official in Jalpaiguri of running a child trafficking operation disguised as a charitable organisation, and even alleged government involvement.

This prompted the CID to take over the investigation in 2017, leading to the arrest of Chakraborty, the head of Bimala Shishu Griha and Ashray, and her brother Manas Bhowmik. The Ashray Orphanage used forged documents and fake stamps and certificates, and had allegedly sold at least two dozen children. According to the CID, the cost for each child sold abroad ranged from Rs three to five lakh, while for those trafficked within India, the charges varied between Rs one and three lakh.

In the course of her interrogation, Chakraborty informed the CID that BJP leader Juhi Chowdhury accompanied her to Delhi to address the trafficking matter and held meetings with BJP leaders Kailash Vijayvargiya and Roopa Ganguly, who were later interrogated by the agency.

Chowdhury was arrested from near the Nepal border, following which the state BJP suspended her and her father, Rabindra Narayan Chowdhury, from the state committee. However, then Rajya Sabha MP Ganguly openly vouched for her innocence. BJP leader Dilip Ghosh also promised to provide her with legal help. In 2018, the West Bengal CID questioned BJP national secretary Kailash Vijayvargiya, who was in charge of West Bengal during that period. Vijayvargiya termed the questioning ‘political vendetta’.

Chowdhury was released on bail two and a half years after her arrest. She told The Wire, “The matter is sub judice. I do not want to comment on this.”

Chakraborty’s brother Bhowmik, also out on bail, has refused to speak to the media.

Since 2020, the case has gone off the radar in West Bengal. Officially though, the CID maintains that the Jalpaiguri child trafficking investigation is ongoing. “People close to the ruling parties at the Centre and in the state were running this racket. North Bengal is strategically located close to Nepal, Assam, Bhutan, Bangladesh, Bihar and Jharkhand. The tea workers are in dire poverty. On the pretext of social activity, they wanted to make huge money by trafficking or selling children in the name of adoption, using agents. They did not follow any laws related to adoption. A section of government officials were involved with them,” said a senior CID official involved in the investigation.

The case also came under scrutiny from the Supreme Court, and in 2020 both the National and West Bengal Commissions for Protection of Child Rights were castigated by the court for losing sight of their primary duty to protect children.

“This case is a classic example where in the fight between the State Commission and the National Commission the children have been, all but forgotten. We are sorry that this Court has to spend its time resolving such disputes,” observed the bench of Justices Deepak Gupta and Aniruddha Bose.

In 2019, Subodh Bhattacharya, the whistleblower un the case, was unceremoniously dropped from the Government Child Welfare Committee by the West Bengal government. In 2023, Subodh and his wife Aparna Bhattacharya died by suicide, leaving a note holding Trinamool Youth Congress leader Saikat Chatterjee and three of his aides responsible for their deaths.

In the suicide note, the couple alleged that Subodh was harassed by Chatterjee for naming him in the child trafficking case. Subodh’s complaint had led to a chargesheet against seven individuals, including Chandana Chakraborty, the names of Chatterjee and three others were omitted by the CID. Chatterjee used to work as Chakraborty’s lawyer and reportedly facilitated 20 of the 52 adoptions from Chakraborty’s shelter homes, but later claimed to have disassociated himself after coming to know of the irregularities.

Chatterjee surrendered to the police in October 2023, following the dismissal of his anticipatory bail plea at the Supreme Court, but was released on bail soon after. His anticipatory bail petition at the Calcutta high court in June 2023 was handled by advocate Kishore Dutta, who became the state’s advocate general earlier this year.

Skill Development Case: SC Refuses Urgent Mentioning of Naidu’s Petition to Quash FIR

In a separate development on Sunday, the Vijayawada ACB court extended the former Andhra Pradesh chief minister’s police custody by 11 days, until October 5.

New Delhi: The Supreme Court on Monday refused urgent mentioning of a petition filed by former Andhra Pradesh chief minister N. Chandrababu Naidu to quash the case registered against him in an alleged skill development scam.

According to LiveLaw, the petition was not included in the list of oral mentions for Monday. Chief Justice of India (CJI) D.Y. Chandrachud refused out-of-turn listing to the petition, asking Naidu’s lawyer Siddharth Luthra to mention it again on Tuesday.

Naidu had filed a special leave petition in the Supreme Court on Saturday challenging the Andhra Pradesh high court’s dismissal of his plea to quash the FIR. Subsequntly, a court in Vijayawada granted two days’ police custody to the Andhra Pradesh Crime Investigation Department (CID) to interrogate Naidu.

On Sunday, with Naidu’s custody set to end, the Vijayawada ACB court extended it by 11 days, until October 5. The Telugu Desam Party (TDP) chief was produced before the court virtually from the Rajahmundry Central Jail.

The leader of the opposition in Andhra Pradesh was arrested early on September 9, as an accused in the FIR registered by the AP CID in 2021 over an alleged multi-crore scam in relation to the Andhra Pradesh State Skill Development Corporation.

During Naidu’s term (2014-19), the state government and two companies initiated a project to create six centres of excellence (CoE) and 36 technical skill development institutes. The estimated cost was around Rs 3,281 crore, which the CID claims is an inflated amount.

The CID claims that Naidu and others allegedly routed hawala transactions through a network of shell companies, did not adhere to procedures and disregarded observations regarding the project’s viability. The TDP has set up a website to counter the allegations, highlighting that Andhra Pradesh established one of the highest numbers of clusters and trained the highest number of candidates among all the states that had similar schemes.

The Andhra Pradesh high court had dismissed Nadiu’s petition to quash the case while noting that the investigation is attaining finality and the court cannot interfere at this stage.

Naidu’s arguments in SC petition

According to LiveLaw, Naidu’s petition in the top court says that he was “suddenly named in the FIR” and arrested in an illegal manner for “political reasons”. While claiming that due process was not followed before his arrest – such as seeking mandatory approval under Section 17-A of the Prevention of Corruption Act, 1988, the plea states that the FIR is a case of “political vendetta”. Naidu and his family “are being targeted to crush all opposition to the party in power in the Respondent State with elections coming near in 2024”, the petition says.

The petition also accused the Andhra Pradesh CID of acting at the behest of the ruling party to damage the TDP’s prospects in the state assembly election, which are scheduled to be held parallel to the general election.

“The CID is threatening the officers and others to implicate the Petitioner, his family and the Party. The continuing political vendetta by the State Administration is demonstrated from the fact that various senior leaders of the Petitioner’s party have in the past been arrested and now hastily are being sought to be implicated in false cases,” the petition says, according to LiveLaw.

Punjab: Journalists in Sangrur Accuse Police of ‘Snooping’

Several media persons said they received calls from the Crime Investigation Department seeking their personal and professional details.

New Delhi: Journalists in Punjab’s Sangrur have accused the police’s intelligence wing of “snooping” after several media persons received calls from the Crime Investigation Department (CID) seeking their personal and professional details.

According to the Times of India, the intelligence wing of the Punjab police has started “profiling” journalists and journalists working for local and English print and electronic media organisations have received these calls from the CID.

The report said that officials asked the journalists for their names, the organisation they work for and other personal details.

Journalists told the newspaper that the arrest of a few unaccredited reporters for alleged blackmail is being used as cover by the CID to profile all media persons. The arrested persons were not registered with the government and used social media platforms, according to reports.

On Friday, in a memorandum submitted to the Punjab chief minister via the deputy commissioner, a group of journalists called the intelligence wing’s actions as “snooping and a direct attack on the fourth pillar of democracy, freedom and privacy of journalists”, according to TOI. They requested chief minister Bhagwant Singh Mann to direct the CID to stop collecting personal details.

The report said that the CID asked journalists for their permanent and present addresses, their current and previous employers and identification (ID) cards issued by the state government. “A CID official called me on my phone and asked for details, including my media organisation and ID card number, on the grounds of verification. Some local journalists allegedly involved in blackmailing activities were arrested recently. By making this as a ground, the police and the establishment want to intimidate genuine journalists too by calling them for verification,” a Sangrur-based journalist told TOI.

According to the Times of India, neither the district public relations department, nor the senior superintendent of police and deputy commissioner claimed to have been unaware about the intelligence wing’s actions.

A senior officer in the public relations department told the newspaper that if the intelligence wing requests details like names of journalists through an official letter, it shares this information. However, details like Aadhaar card, residential address and bank accounts are not shared with any third parties, the officer said.

“I want a CID investigation. BJP’s Rakesh Singh, the aide of Kailash Vijayvargiya, should be arrested. This is his conspiracy,” Goswami told reporters while being taken to lock-up from a city court.

Singh, a BJP state committee member, alleged that the ruling Trinamool Congress and the Kolkata Police were conspiring against him and have “brainwashed” Goswami. He said that he has not been in touch with Goswami for more than a year and was ready to face any investigation.

“If I am involved, they can call me or Kailash Vijayvargiya or Amit Shah. I think the police have brainwashed her. I am not in touch with Pamela for more than one and a half years now,” Singh told PTI. “This can be that the Kolkata Police is following the Trinamool Congress’s instructions. They are conspiring against me. These are baseless accusations, and I am ready to face any challenge,” he added.

The Trinamool Congress said that the whole episode portrays the “true character” of the BJP. “Earlier, one of their leaders was arrested for involvement in child trafficking. Now another one is arrested in the drugs case. This only proves what the BJP and its leaders are up to,” TMC’s secretary-general and state minister Partha Chatterjee said.

Assam CID Arrests State Chief Secretary’s Brother in Police Exam Paper Leak Scam

SP Kumar Sanjit Krishna is the highest-ranked serving officer of the Assam government arrested so far in the scam that has rocked the state.

Guwahati: The Assam CID Thursday arrested superintendent of police Kumar Sanjit Krishna, who is the brother of the state chief secretary in connection with the police exam paper leak scam in the state.

Krishna is the brother of chief secretary Kumar Sanjay Krishna.

A senior official told PTI that Sanjit Krishna was arrested by the CID after completing his medical check-up, which was done following a series of marathon interrogation over the last few days.

“He will be produced before a court tomorrow and we will seek his custody,” the official said.

Sanjit Krishna, who was suspected to be absconding on Wednesday, reached the state police headquarters here at around 11 am and was questioned by top Assam police officials the whole day, a source in it told PTI.

At around 6 pm he was detained and the CID sleuths took him to their headquarters, which is about 200 m away. His medical check-up followed.

The senior police officer was interrogated for long hours on Monday and Tuesday too by the top brass of Assam Police.

Krishna was the SP of Karimganj district, where the question paper was allegedly leaked at his behest in his residence in the presence of other accused persons in the scam, some of whom have already been arrested.

The SP, who is a senior officer of the Assam Police Services, was transferred to Barpeta district as the superintendent of police of the Foreigners Regional Registration Office (FRRO) on October 11, 2020, which was a Sunday raising questions over the investigation.

His official residence at Karimganj was searched on Sunday and Tuesday, while his personal house was searched by the CID on Wednesday.

Assam Chief Secretary Kumar Sanjay Krishna had said in a Facebook post on Tuesday that if his brother has done something wrong then “law will take its own course on the basis of evidence”.

“As Chief Secretary, I have been supporting on independent and neutral enquiry from the beginning … and I believe whoever is guilty will be brought to justice,” he had added.

So far multiple agencies of the Assam Police have arrested 51 people from different parts of the state and outside it, including retired DIG Prasanta Kumar Dutta and BJP leader Diban Deka who was later expelled from the party.

The police have so far registered five cases across the state.

The CID has arrested 21 people so far, while the Nalbari police have taken in 14 others. The crime branch of Guwahati Police has arrested 11 persons and the Lakhimpur district police five others. There has been no arrest yet against the case registered at Diphu in Karbi Anglong district.

The CID had searched the house of Dutta’s employee Jaydip Borooah, who was in hospital following the detection of COVID-19 and seized 24,88,300, an Assam Police spokesperson said.

With this, nearly Rs 5.65 crore cash has been recovered from different places in the state in connection with the scam, he added.

On September 20, 2020, the question paper of the written examination for 597 posts of unarmed sub-inspectors in Assam Police was leaked and the State Level Police Recruitment Board (SLPRB) cancelled the test minutes after it had commenced across the state that day.

Around 66,000 candidates had downloaded their admit cards for appearing in the written tests in 154 centres spread over all the districts.

SLPRB Chairman Pradeep Kumar had later resigned owning moral responsibility for the scam and the state government had reconstituted the board with the director-general of police as its chairman.

Palghar Mob Lynching: 3 Policemen Dismissed From Service

Two seers and their driver lynched by a mob at Gadchinchale village in Palghar on April 16. They were travelling in a car to Surat to attend a funeral in the lockdown.

Palghar: Three police personnel have been dismissed from service in connection with the Palghar mob lynching case in Maharashtra, a senior official said on Sunday.

These police personnel are assistant police inspector Anandrao Kale, who was in charge of Kasa Police Station in Palghar when the incident took place on April 16, the official said.

Two others are assistant sub inspector Ravi Salunke and constable Naresh Dhodi, he said.

“The Inspector General (IG) of Police, Konkan Range dismissed the trio from service through an order issued on Saturday,” the official added.

These three police personnel, along with their five other colleagues, had been placed under suspension following the incident, he said.

Two seers and their driver were lynched by a mob at Gadchinchale village in Palghar on April 16 when they were travelling in a car to Surat (Gujarat) to attend a funeral amid the coronavirus-induced lockdown.

The victims were identified by the police as Chikne Maharaj Kalpavrukshagiri (70), Sushil Giri Maharaj (35) and their driver Nilesh Telgade (30).

The brutal mob attack took place amid rumours that child-lifters were roaming in the area.

As many as 154 people have been arrested and 11 juveniles detained in connection with the incident. The accused in the case were charged with murder, armed rioting and using criminal force to prevent a public servant from doing is duty, among other offences, police said.

The case was later handed over to the Maharashtra Criminal Investigation Department (CID) for probe. It has filed three charge sheets in the case.

After the incident caused an uproar, the state government had suspended Kale, under whose jurisdiction the crime took place, and seven other policemen. Besides, over 35 police constables and personnel of other ranks were transferred in the wake of the mob attack.

The government had also sent the then Palghar district police chief, Gaurav Singh, on forced leave.

Bengal CID Questions BJP’s Mukul Roy in TMC MLA Murder Case

Roy, one of the founding members of TMC, left for BJP in 2017.

Kolkata: BJP leader Mukul Roy was interrogated on Thursday by sleuths of the West Bengal CID in connection with the killing of Trinamool Congress (TMC) MLA Satyajit Biswas, officials said.

Roy reached the agency’s headquarters at Bhabani Bhaban around 10.30 am, they added.

An officer of the CID’s homicide department was leading the interrogation, a senior official said, adding that Roy was being asked about his acquaintance with Biswas, among other things.

Roy had skipped an earlier summons issued by the agency, citing an urgent meeting in Delhi, the official said.

Biswas was shot dead at a Saraswati Puja pandal in Nadia district in February 2019. Several BJP leaders, including Roy and the party’s district president Jagannath Sarkar, were named in the FIR lodged in connection with the incident.

The probe was handed over to the CID, which has questioned Sarkar twice.

Four persons have so far been arrested in the case.

Kalburgi’s Wife Identifies Suspect Who Shot Him

27-year-old Ganesh Miskin, linked to the extremist group Sanatan Sanstha, is also accused in the Gauri Lankesh killing.

New Delhi: The wife of Kannada scholar M.M. Kalburgi, who was murdered at his home in Dharwad district in Karnataka on August 30, 2015, has identified on Wednesday one of the accused involved in his murder in a test identification parade.

According to an Indian Express report, the man identified by Umadevi Kalburgi is 27-year-old Ganesh Miskin, who has been linked to Hindutva extremist group Sanatan Sanstha. Miskin has previously been identified as a suspect in the murder of journalist Gauri Lankesh in Bengaluru in September 2017.

Kalburgi’s son Shreevijay Kalburg told the Indian Express that his mother had identified the culprit. However, “the name of the person who was identified was not disclosed to us,” he added.

Earlier, a preliminary forensic analysis of bullets and empty cartridges found at the scene of Lankesh’s murder had revealed that the same countrymade pistol was used to kill Kalburgi two years prior as well, suggesting that one outfit or group was responsible for both the killings.

In January 2018, Umadevi told the Supreme Court that the organisations responsible for her husband’s death were also behind the murders of rationalist thinkers Narendra Dabholkar in August 2013 and Govind Pansare in February 2015. “All three were abused, threatened by certain sections of the society,” she said.

Members of the Sanatan Sanstha or its offshoot, Hindu Janajagruti Samiti, have been arrested in the murder cases of Kalburgi, Dabholkar, Pansare and Lankesh. The outfits aim to establish India as a ‘Hindu nation’ and its members have also been arrested in connection with bomb blasts in Thane and Vashi.

In February 2019, the SIT, which was set up to investigate the Gauri murder case, was directed to probe the Kalburgi assassination case also by the Supreme Court.

An unidentified source told the New Indian Express that “the SIT will soon submit the chargesheet in the Kalburgi case”.

Miskin is suspected to be the motorcycle rider who had ferried Lankesh’s shooter Parshuram Waghmare.

Miskin, who was arrested in July 2018, had reportedly told the SIT that the motorcycle in question was allegedly stolen by a mechanic by the name of Suryavanshi to execute the Kalburgi murder.

Kalburgi, a Sahitya Akademi Award winner, was shot dead by two assailants right outside his home, when he went to open the door, on August 30, 2015. The year before he died, Kalburgi had become the target of a campaign by the Vishwa Hindu Parishad and other right-wing forces, which had burnt his effigy and demanded his arrest for remarks he made against idol worship.
