Deep Pockets, Weaponised Agencies the Muck BJP’s Operation Lotus Grows In

The increasing misuse of ED as an instrument of power is borne out by a steep 95% rise in its actions since Modi came to power. The central probe agencies are being used to engineer defections from Opposition parties like never before.

Aam Aadmi Party (AAP) boss Arvind Kejriwal hit the bull’s eye when he said that if he got control of the Enforcement Directorate (ED) and Central Bureau of Investigation (CBI) just for a day, half of the Bharatiya Janata Party (BJP)’s leaders would find themselves in jail. He was highlighting the selective use of the enforcement agencies against the BJP’s political rivals, carefully sparing its own functionaries. In seven years, they filed 167 cases against AAP leaders but not one was proved in court. In 150 cases, they were cleared… 800 sleuths were unleashed on AAP… Even the deputy CM has been made an accused in an FIR…

Much of what Kejriwal revealed is widely known but big media outlets stay clear of acknowledging this. The enforcement agencies have emerged as the chief instrument in the Modi government’s arsenal for spreading the ruling party’s political base to areas where the Opposition is strong.

It is part of a well-defined arrangement in which the ED/CBI/IT are tasked to perform two political tasks – providing vital input to the political leadership on rivals’ vulnerabilities, and coercing them through raids, arrests and litigation. The first is done through informal private leaks within the parivar and direct media leaks. The arrangement is so perfect that agency sleuths informally liaise with designated BJP officials. They were even seen in each other’s vehicles.

The ruling party systematically uses such information to further expose and torment Opposition leaders. To facilitate this, the ED recently issued a notification expanding the list of agencies with which it will exchange information. Critics smell a rat in this surprise announcement.

The selective use of punitive might is used to tire out political rivals. On the eve of every election, selected Opposition leaders are made special targets of raids and accusations. The practice began with Modi’s advent in 2014 and got a fillip after the present ED boss assumed office. He has now been given a most unusual third extension, even though the matter of his tenure had been raised earlier in the Supreme Court.

Among Opposition targets, the Congress topped the list with 24 prosecutions followed by Trinamool Congress with 19 and Nationalist Congress Party with 11. Since then, things have gotten worse. The Rajya Sabha was told that there was a 27-fold rise in the number of ED raids from 112 in 2004-2014 to 3,010 in 2014-2022. Almost all the victims were Modi’s political rivals.

The enforcement agencies are also used to broker defections from Opposition parties. Manish Sisodia of AAP presented an audio clip featuring offers to drop the cases against him if he crossed over to the BJP. If true, this marks the worst kind of misuse of agencies for political gains, i.e., using them to bargain with political rivals for defections. Earlier, four AAP Delhi MLAs had alleged that they were threatened with ED/CBI raids if they did not cross over to the BJP.

The success of ‘Operation Lotus’ in Maharashtra, which toppled the Maha Vikas Aghadi (MVA) government in June, is sought to be replicated in almost all non-BJP states – Delhi, Chhattisgarh, Telangana and even Punjab. A closer look at toppling operations in the last few months shows that direct payment of big money, rather than positions, is the lure, coupled with offers to withdraw ED/CBI harassments. Kejriwal has claimed that 277 MLAs defected to the BJP after winning on tickets from other parties. He calculates that at the rate of Rs 20 crore per MLA, the ruling party has spent at least Rs 5,500 crores on this. This was based on the allegation of the four Delhi AAP MLAs, that they were offered Rs 20 crore each to defect. And Rs 25 crore would be paid if they brought along other MLAs. Refusal would have brought on ED raids.

On October 30, Sisodia said that BJP ‘brokers’ were plotting to ‘buy’ 43 Delhi MLAs for Rs 1,075 crore. He also played an audio clip in which brokers, apparently acting on behalf of the BJP, were heard offering Rs 100 crore for the defection of TRS MLAs.

Obviously, Operation Lotus in Telangana, to topple the Telangana Rashtra Samithi (TRS) regime, began with great hopes of Shiv Sena-type mass defections. This was accompanied by coercive action against TRS ministers and MLAs. However, the plan misfired because the state police, which got wind of it early, acted fast. Many of the shady deals, including huge direct cash payments, were recorded by hidden cameras. Later, the chief minister called the media and played the clips which talked of code words like ‘nariyal pani’ and ‘vitamin’. As per the plan, the first lot of 20-30 MLAs were to defect on direct cash payment and form a separate group. Three agents, including a Kerala politician and a godman, were arrested by the Telangana Police.

Direct cash payment supported by ED/CBI coercion has become an integral part of Operation Lotus. Ashok Gehlot told NDTV that he had evidence to show that Rs 10 crore was distributed to MLAs holed up at a Gurgaon resort during the toppling bid in Rajasthan. A Rajasthan Congress minister said he was offered Rs 25 crore if he voted for the BJP in the Rajya Sabha polls.

Three Jharkhand Congress MLAs were arrested in West Bengal on charges of involvement in an attempted Operation Lotus there. The state CID also seized hawala money from them. The AAP in Punjab alleged that Rs 20-25 crore was being offered to its MLAs in a bid to topple its government.

BJP general secretary B.L. Santhosh, who is also Nagpur’s point man in the party, has emerged as Team Amit Shah’s toppling sutradhar. He figures in most of the recent cash-for-defection cases. He evaded two summons asking him to appear in the Telangana case. Clips released by the Telangana chief minister mention the topmost BJP leaders 23 times, indicating the likelihood that they play a direct role in Operation Lotus. One of the clips also has the broker saying that “we have already dethroned eight state governments and now Telangana, Delhi, AP and Rajasthan are in the list”.

The claims made in the Telangana clip seem perfectly plausible. Engineering defections is a crucial part of Amit Shah’s expansion strategy. Almost the entire Northeast was ‘conquered’ through defections — 93 MLAs in eight years. Three JD(S), 11 Congress and two independent MLAs defected in Karnataka, bringing the BJP back to power in the state three years ago. In Goa, barely two months after the first defections, 11 MLAs were spirited away to BJP. Now the Congress is left with just three MLAs in a house of 40.

TRS MLAs ‘Poaching’ Case: BJP Leader BL Santhosh, Three More Named as Accused

Following directions from the Telangana high court, the SIT, probing the case, issued a second notice to BJP national general secretary (Organisation) Santhosh, who is yet to appear before it.

Hyderabad: Senior BJP leader B.L. Santhosh and three others were named as accused by the Special Investigation Team (SIT) in the case of alleged conspiracy to poach four TRS MLAs, officials said on Thursday.

Following directions from the Telangana high court, the SIT, probing the case, also issued a second notice to BJP national general secretary (Organisation) Santhosh, who is yet to appear before it.
In the fresh notice, he has been asked to appear before SIT for questioning on November 26 or November 28, official sources told PTI.

Based on the investigations so far, the SIT filed a memo in a special anti-corruption bureau (ACB) court here adding the names of Santhosh and two persons from Kerala – Jaggu Swami and Tushar Vellapally, besides B. Srinivas, as accused in the case, they said.

Three persons – Ramachandra Bharati alias Satish Sharma, Nanda Kumar and Simhayaji Swamy, were already named as accused in the case after a complaint was lodged by TRS MLA Pilot Rohith Reddy, among four legislators, against them on October 26.

As per the FIR copy, Rohith Reddy alleged that the accused offered him Rs 100 crore and in return, the legislator had to leave the TRS and contest as a BJP candidate in the next Assembly election.

The Telangana high court on Wednesday had directed the SIT to again serve notice on Santhosh under Section 41A of the Code of Criminal Procedure (CrPC) to Santhosh.

Earlier, the Telangana SIT had issued notices to Santhosh and the two persons from Kerala to appear before it for questioning on November 21. However, they did not turn up before the probe panel. Srinivas, who was also summoned by the SIT, had appeared before it.

The Telangana government on November 9 ordered the setting up of a seven-member SIT to probe into the alleged poaching of the MLAs.

‘Has Clearance from the Highest Level’: Accused in TRS MLAs Poaching Case in Leaked Audio Clip

The main accused is heard saying that the move has clearance from “Number One” and “Number Two”, which according to TRS, referred to Prime Minister Narendra Modi and Union home minister Amit Shah, respectively.

New Delhi: A day after Telangana Police detained three persons for allegedly bribing Telangana Rashtra Samithi (TRS) MLAs to join the Bharatiya Janata Party (BJP), a purported audio clip of a telephonic conversation between the main accused, Ramachandra Bharati, alias Satish Sharma alias Swamiji, and one of the MLAs Pilot Rohith Reddy surfaced on Friday, October 28.

The main accused is heard saying once Reddy ropes in an adequate number of TRS MLAs, Santosh (reportedly B.L. Santosh, BJP national secretary) would come down to Hyderabad to finalise the “deal”. Santosh’s name is heard repeatedly throughout the conversation. Bharati is also heard saying the move has “clearance” from the “highest” levels, including from “Number One” and “Number Two”.

According to TRS, “Number One” and “Number Two” refer to Prime Minister Narendra Modi and Union home minister Amit Shah, respectively. The audio clip, lasting nearly 14 minutes, was leaked by the TRS on Friday. The Wire has not been able to independently verify the authenticity of the audio clip.

The alleged poaching attempt by the BJP has raised the political temperature in the state, where BJP and TRS are caught in a pitched battle ahead of the November 3 bypoll in Munugode. According to Cyberabad Police, money, contracts and posts were offered to TRS MLAs Guvvala Balaraju (Atchampet assembly segment), B. Harshavardhan Reddy (Kollapur), Rega Kantarao (Pinapaka) and Pilot Rohith Reddy (Tandur). The TRS alleged that each MLA was offered up to Rs 100 crore, and the accused shared close ties with the national leadership of the BJP.

At one point in the alleged telephonic conversation, Bharati asks Reddy, “Can you share the names with Number Two?”

When Reddy seems reluctant to share the names of other MLAs who are ready to shift their allegiance, Bharati says, “It is our responsibility to take care of you. When you are under our scanner, you don’t have to worry, including from ED to the income tax. We have good experience in Bengal.”

Bharati is also heard saying that Santosh had gone to Ahmedabad with “Number Two” and the matter would be taken up after the “bulk is ready”. He also says that they are in need of “qualified leaders” while assuring that “all aspects” would be taken and not to worry.

At this point, another accused Nanda Kumar interrupts the conversation and proposes the idea of scheduling a meeting after October 25, citing the solar eclipse on October 25.

The TRS hit back sharply after the audio leak on Friday. “We will expose the BJP before the people. The downfall of BJP will start with the results of the Munugode Assembly bypoll,” said TRS leader and state energy minister G. Jagadish Reddy, according to The New Indian Express.

Meanwhile, an Anti-Corruption Bureau court in Hyderabad rejected the plea of police to send the three accused to judicial custody. Subsequently, the police approached the Telangana high court challenging the decision of the ACB court.

The accused have been, according to the police, identified as Ramachandra Bharati alias Satish Sharma, a priest from Faridabad in Haryana; Simhayaji, pontiff of Srimanatha Raja Peetham in Tirupati; and Nandakumar, owner of a restaurant, Deccan Pride in Hyderabad.

Meanwhile, BJP leader and Union minister G. Kishan Reddy rubbished the incident as a “scripted flop show” by the TRS to defame the BJP ahead of the Munugode bypoll. He said the entire episode was carried out under the direction of TRS supremo and chief minister K. Chandrashekar Rao.

The Union minister has also sought an inquiry by the Central Bureau of Investigation (CBI) or a sitting judge of the Supreme Court, into the whole episode. “If the TRS government has purity of mind, I request that the case be handed over to the CBI. I am asking whether the state government is ready for this? I am giving two options. Either you get it inquired by a Supreme Court sitting judge or hand it over to the CBI as this case is an interstate issue.”

Disqualified MLAs Will Join BJP on Thursday: Karnataka CM, Deputy

Deputy CM Ashwathnarayan said the disqualified MLAs will join the BJP on Thursday morning.

Bangalore: Hours after the Supreme Court on Wednesday paved the way for the disqualified Congress-JD(S) legislators in Karnataka to contest the December 5 assembly bypolls, chief minister B.S. Yediyurappa and deputy chief minister Ashwathnarayan C.N. said they will be joining the BJP on November 14.

In a related development, the state BJP’s core committee met and discussed the candidates for the bypolls to 15 of the 17 vacant seats, but did not take any final decision.

Speaking after the core committee meeting, Yediyurappa said the disqualified MLAs have expressed intention to join the party on Thursday and they would be given the membership.

Earlier, Ashwathnarayan said the disqualified MLAs will join the party on Thursday at 10.30 am here in the presence of Yediyurappa and BJP state President Nalin Kumar Kateel.

“They (disqualified legislators) have expressed interest to join BJP and have met our senior leaders. They have been welcomed to join the party,” he told reporters in Delhi.

Some disqualified MLAs along with Ashwathnarayan met B.L. Santosh, BJP national general secretary (organisation), in New Delhi hours after the verdict.

Ashwathnarayan said party leaders and the disqualified legislators will meet the chief minister and the state president on Thursday and decide on the future course of action.

“There is no trouble or anything, they want to join the party and will be joining… bypolls and other things will come later,” he said.

The Supreme Court on Wednesday upheld the disqualification of 17 Congress-JD(S) MLAs by the then Speaker K.R. Ramesh Kumar but allowed them to contest the December 5 bypolls in the state.

The court struck down the portion of the order of then Speaker by which the legislators were disqualified till the end of the 15th Karnataka assembly in 2023.

Asked if they have been promised ticket for bypolls, Ashwathnarayan said they are joining with joy and full faith.

“They, our friends have no doubt. They are joining the party keeping good faith, when they don’t have doubts, why you (media) have,” he added.

Karnataka BJP general secretary Arvind Limbavali said the core committee discussed about the candidates for the bypolls but no decision has been taken. A final call on it is likely by Thursday evening.

BJP sources said it is no secret that the disqualified MLAs – most of them at least – would be given the tickets to contest the polls.

Yediyurappa too had recently spoken about the plans to give tickets to them, if they intend to contest as BJP candidates.
