ED Arrests Maharashtra Ex-Home Minister Anil Deshmukh After 12-Hour Interrogation

Deshmukh appeared before the agency after the Bombay high court last week refused to quash ED summons against him. He had skipped at least five ED notices.

Mumbai: Former Maharashtra home minister Anil Deshmukh was arrested by the Enforcement Directorate (ED) late Monday night after over 12 hours of questioning in a money-laundering case linked to an alleged extortion racket in the state police establishment, officials said.

They said Deshmukh, 71, was arrested under the provisions of the Prevention of Money Laundering Act (PMLA).

They claimed the senior NCP leader was evasive during questioning and the agency will seek his custody after they produce him before a local court here on Tuesday.

The politician arrived at the ED office in the Ballard Estate area of south Mumbai around 11:40 am, accompanied by his lawyer and his associates and was soon after put under grilling sessions with some breaks in between, sources said.

The money laundering case against Deshmukh and others was made out after the CBI booked him in a corruption case related to allegations of at least Rs 100 crore bribery made by former Mumbai police commissioner Param Bir Singh.

The federal probe agency recorded the statement of the NCP leader under the Prevention of Money Laundering Act (PMLA) in connection with the criminal investigation being carried out by it in the alleged Rs 100 crore bribery-cum-extortion racket in the Maharashtra Police establishment that led to Deshmukh’s resignation in April.

The questioning and recording of statements sessions went for long as officials said Deshmukh was a “key person” in this case and needs to be grilled on a number of subjects including the disclosures made by suspended Mumbai Police officer Sachin Waze during ED questioning.

Deshmukh released a video message before going to the ED office in which he said that he himself is deposing before the agency after the Bombay HC order came last week.

“It was reported in the media that I was not cooperating with the ED…I went to the CBI twice after I was summoned…my petition is still pending in the Supreme Court but it will take time and hence I myself have gone to the ED,” he said.

“I and my family cooperated with the ED when they raided us (in June),” he said.

Deshmukh questioned the whereabouts of Param Bir Singh. “He made the bribery allegations against me but where is he now.”

The Bombay high court, in its judgement issued on October 29, said Deshmukh failed to prove that probe agencies had been acting in a malafide manner against him.

It said if Deshmukh apprehended his arrest by either the ED or the CBI, he had the right that was available to any other citizen or litigant to approach the appropriate court to seek protection.

The court, however, directed the ED to permit Deshmukh’s lawyer to remain present within “visible distance but not audible distance” during the questioning.

The ED case of money laundering against Deshmukh, who was earlier the home minister in the Maha Vikas Aghadi (MVA) government, and others came after the CBI booked him in the corruption case related to allegations of bribe made by former Mumbai Police commissioner Singh.

The first summons to Deshmukh, his wife and son Hrishikesh came soon after the ED raided their premises in Mumbai and Nagpur in June.

It subsequently arrested two of his aides in this case, personal secretary Sanjeev Palande (51) and personal assistant Kundan Shinde (45).

The ED also had attached assets worth Rs 4.20 crore that were stated to be “beneficially owned” by Deshmukh.

It claimed the probe found that “Deshmukh, while acting as home minister of Maharashtra, with dishonest intention has received illegal gratification of approximately Rs 4.70 crore in cash from various orchestra bar owners, through (suspended) Sachin Waze, then the assistant police inspector of Mumbai Police.”

“Further, with the help of Delhi based dummy companies, Deshmukh family laundered the tainted money of Rs 4.18 crore and projected it as untainted by showing the same as amount received in the Trust namely Shri Sai Shikshan Sanstha,” the ED had alleged.

The ED case against Deshmukh and others was made out after the CBI booked him in a corruption case related to allegations of at least Rs 100 crore bribery made by former Mumbai Police commissioner Singh.

In a letter to Chief Minister Uddhav Thackeray after he was removed from the police commissioner’s post, Singh had alleged that Deshmukh had asked Waze to extort over Rs 100 crore a month from bars and restaurants in Mumbai.

Deshmukh, while denying any wrongdoing, had maintained that Singh made the allegations against him after he was removed from the post of Mumbai Police chief.

Deshmukh, who resigned from the post of state home minister in April, is facing a probe by central agencies on multiple charges.

Mumbai: The Maharashtra government has moved the Bombay high court, challenging the recent summons issued by the Central Bureau of Investigation (CBI) to state chief secretary Sitaram Kunte and director general of police Sanjay Pandey in connection with the FIR registered by the central agency against former Maharashtra home minister Anil Deshmukh.

The state government filed a writ petition on Tuesday and mentioned it on Wednesday before a bench of Justices Nitin Jamdar and S.V. Kotwal, seeking urgent hearing.

The HC posted the plea for hearing on October 20.

Earlier this month, the CBI issued summons to Kunte and Pandey, asking them to appear before it this week in connection with the FIR registered with the probe agency against NCP leader Deshmukh for alleged political interference in transfers and postings of police officers.

The allegations of such interference and misconduct on part of Deshmukh were made by former Mumbai police commissioner Param Bir Singh in March this year through a letter to chief minister Uddhav Thackeray.

Following a subsequent order of the Bombay high court, the CBI conducted a preliminary enquiry into the allegations. In April this year, the central agency registered the FIR against Deshmukh and other persons.

Deshmukh, who resigned from the post of state home minister in April, is facing a probe by central agencies on multiple charges.

He has repeatedly denied the allegations levelled against him.

Leaked CBI Report Giving Clean Chit to Anil Deshmukh Is Genuine: NCP

The Central agency has said the report was leaked after a bribe was paid and has arrested two persons, including Deshmukh’s lawyer.

New Delhi: The Nationalist Congress Party (NCP) leader and Maharashtra minority affairs minister Nawab Malik on Thursday claimed that a leaked Central Bureau of Investigation (CBI) report which purportedly gave a ‘clean chit’ to former Maharashtra home minister Anil Deshmukh in a corruption case was genuine.

The Central agency said that the report was leaked after a bribe was paid and it has registered a criminal case in this regard.

Speaking to reporters, Malik asked why the CBI has not said if the report is fake or genuine, he said.

“To save its face, it is saying that the report had been managed,” Malik alleged. “If the report is presented in court, Anil Deshmukh will get a reprieve. Whatever is happening is all politically motivated,” he added.

The CBI on Thursday arrested Deshmukh’s lawyer Anand Daga for allegedly trying to subvert a Bombay high court-directed preliminary enquiry against the former Maharashtra minister.

It has also arrested CBI sub-inspector Abhishek Tiwari for allegedly receiving a bribe from Daga. A report of the preliminary enquiry purportedly giving clean chit to Deshmukh was leaked on Saturday night. The CBI started a probe into the leak and claimed that the findings of the enquiry had been influenced.

The Bombay high court had directed the agency to start a preliminary inquiry while hearing a public interest litigation on allegations of corruption levelled by former Mumbai police commissioner Param Bir Singh against Deshmukh.

Deshmukh moves HC against summons

Meanwhile, Deshmukh on Thursday moved the Bombay high court, seeking the Enforcement Directorate (ED)’s summons issued to him in connection with a money laundering case registered against him to be quashed. He also sought the probe to be handed over to an SIT of ED officers outside Mumbai.

Deshmukh’s application came up for hearing before a single bench of Justice Revati Mohite Dere. However, Justice Dere recused herself from hearing the application without assigning any reason and said, “Not before me.”

The application will now be heard by another bench.

The ED had initiated a probe against Deshmukh and his associates after the CBI lodged an FIR against him on April 21 this year on charges of corruption and misuse of official position.

The ED’s case is that while serving as the state home minister, Deshmukh allegedly misused his position and through dismissed police officer Sachin Waze collected Rs 4.70 crore from various bars and restaurants in Mumbai.

The money was allegedly laundered to the Nagpur-based Shri Sai Shikshan Sansthan, an educational trust controlled by Deshmukh’s family.

The ED has till now issued five summons to Deshmukh, asking him to appear before it for questioning. However, Deshmukh skipped all the five summons, saying he would be seeking appropriate remedies available under law.

Deshmukh last month approached the Supreme Court against the summons and sought protection from arrest. The apex court had, however, refused to grant any relief and said Deshmukh had alternate remedies.

The NCP leader then approached the HC, challenging the summons.

The ED has so far arrested two persons – Sanjeev Palande (an additional collector-rank official who was working as Deshmukh’s private secretary) and Kundan Shinde (Deshmukh’s personal assistant) – in the case.

The CBI had lodged the FIR against Deshmukh after it conducted a preliminary enquiry against him following an order from the HC on April 5. Deshmukh resigned as the home minister on the same day but has denied any wrongdoing.

Mumbai: Former Maharashtra home minister Anil Deshmukh on Monday filed a petition in the Bombay High Court seeking to quash the FIR registered against him by the Central Bureau of Investigation on the charges of corruption.

The plea is likely to be heard by a division bench of Justices S.S. Shinde and Manish Pitale this week.

The CBI on April 21 registered an FIR against the NCP leader under section 7 of the Prevention of Corruption Act which deals with illegal gratification obtained by a public servant and section 120 (b) (criminal conspiracy) of the Indian Penal Code (IPC).

The CBI had initiated a preliminary enquiry (PE) against Deshmukh on orders of the Bombay HC based on the petitions filed by advocate Jayshri Patil and former Mumbai police commissioner Param Bir Singh, who had levelled allegations of corruption and malpractices against the NCP leader.

In his letter to Maharashtra Chief Minister Uddhav Thackeray, Singh had alleged that Deshmukh had asked API Sachin Waze, currently probed by the NIA in the cases of ‘Antilia’ bomb scare and the Mansukh Hiran murder, to collect Rs 100 crore as bribe from bars and restaurants in Mumbai every month.

Singh wrote the letter after he was shunted from the post of the Mumbai police commissioner and appointed as the DG, state Home Guards.

The CBI had questioned Deshmukh and conducted searches at his premises. The Central agency had also questioned Singh and others.

Deshmukh, who had rejected the allegations levelled against him, resigned as home minister on April 5 after the HC ordered the PE against him.

CBI Registers FIR Against Ex-Maharashtra Minister Anil Deshmukh in Alleged Bribery Case

The probe agency had carried out a preliminary enquiry on the orders of the Bombay high court to look into the allegations against Deshmukh levelled by former Mumbai police commissioner Param Bir Singh.

New Delhi: The CBI has registered an FIR against former Maharashtra home minister Anil Deshmukh in connection with allegations of bribery against him and carried out searches at various locations in Mumbai on Saturday, officials said.

The probe agency had carried out a preliminary enquiry on the orders of the Bombay high court to look into bribery allegations against him levelled by former Mumbai police commissioner Param Bir Singh, they said.

According to the officials, during the enquiry, the CBI got enough prima facie material to start a formal probe by registering a regular case against Deshmukh and other unidentified persons under the provisions of the Prevention of Corruption Act.

After registering the case, the CBI started a search operation at a number of locations, including the premises of Deshmukh, in Mumbai, they said.

On March 25, Param Bir Singh had filed criminal public interest litigation seeking a CBI probe against Deshmukh who, he claimed, had asked police officers, including suspended cop Sachin Waze, to extort Rs 100 crore from bars and restaurants.

Waze is facing an NIA probe in the case of an explosive-laden SUV found near industrialist Mukesh Ambani’s house in Mumbai.

Singh had initially approached the Supreme Court, alleging he was transferred from the post of Mumbai police commissioner after he complained to chief minister Uddhav Thackeray and other senior leaders about the “corrupt malpractices” of Deshmukh.

The apex court had termed the matter as quite serious but asked Singh to approach the high court.

Singh then filed the PIL in the high court, reiterating his allegations against Deshmukh and seeking an “immediate, unbiased, impartial” probe by the CBI against Deshmukh, who is an NCP leader.
