HC Notice on Plea Seeking FIR, NIA Probe Against Harsh Mander, Swara Bhaskar, Others

The plea has been filed by advocate Sanjjiiv Kkumar, whose petition says, “The plan of this Urban Naxal group was to defame India, to paint India as Failed State and thus to bleed my Mother India internationally, economically and in every way possible.”

New Delhi: The Delhi high court issued notice to the Centre, Delhi government and Delhi police on a plea seeking hate speech FIRs against Swara Bhaskar, Harsh Mander, RJ Sayema, AAP MLA Amanatullah Khan and others. The application also seeks a National Investigation Agency investigation into these people.

The case was heard by a division bench of Chief Justice D.N. Patel and Justice Hari Shankar. They will next hear the matter on April 13.

The plea has been filed by advocate Sanjjiiv Kkumar, whose petition says, “The plan of this Urban Naxal group was to defame India, to paint India as Failed State and thus to bleed my Mother India internationally, economically and in every way possible.”

The people he has mentioned, Kkumar is quoted by LiveLaw as saying, were planning a “siege” in Delhi by blocking roads:

“The plan seems to got failed as the perpetrators of the Delhi Seige hasn’t anticipated that People mostly Hindus will react to any further Road Blockaage and they couldn’t divert the police from other locations. This was their Guerilla Tactics to block Roads of Delhi by creating Riots and Riots like situation all over Delhi (sic).”

In addition to names mentioned above, the plea also wants FIRs (but no NIA probe) against three BJP leaders – Kapil Mishra, Anurag Thakur and Parvesh Mishra – for making speeches that instigated the Delhi riots. They must be arrested immediately, the petition says.

“This incident (Kapil Mishra’s speech) led to a gathering of armed mobs in Maujpur with loud chanting of communal slurs and chanting of ‘Goli Maro Salo Ko’ and ‘Jai Shri Ram’,” the plea says.

Another case asking for an FIR against three leaders, also heard in the Delhi high court, has become controversial recently after the quick transfer of Justice S. Muralidhar. On the day the judge held three key hearings on the Delhi riots and passed orders that annoyed the Modi government at the Centre, the law ministry issued a notification formally shifting him from the crucial Delhi high court to the Punjab and Haryana high court.

Justice Muralidhar had pulled up the Delhi police for not filing FIRs against the three leaders, and reminded the police of the Lalita Kumar guidelines.
